Loaning money and want it repaid back?
Hi all,

I have a dilema with an ex. Last year I lent her money for her to pay a cell phone bill (twice I might add), since then she claims that it was something I wanted to give to her, but here's the catch, before that i made her sign an agreement saying that whatever money I lent to her will be Paid in full. My question is am I entitlted to that money back? Mind you..she gave me operative word here is GAVE me a playtstation to keep (which was hers.) What do I do in a situation like this?

You don't say when she GAVE you the playstation. Was it
before or after the loan?
If it was after the loan, you shouldn't have accepted the playstation without having amended the agreement stipulating that the playstation was a gift, and didn't have anything to do with the loan. If the gift was given to you
before the loan, she may want to justify the value of the gift
equal to the value of the loan.
You may want to consider taking her to small claims court.
Let them sort it all out.
It'll probably wind up as a "he said, she said" kind of thing.
In the end, you may have to swallow your pride and accept
it as a bad, but well intentioned, loan.
Without clear proofs, this is the best advice I can offer you.
Learn from this, and move on.

If you feel like to have tried yourself with no resolve to get the money from her and haven't gotten it yet take her to small claims court.Or maybe at least threaten her with it and who knows maybe you can work out a payment plan and if still nothing do the small claims court.Unless you know some shady folks to break her knee caps.(that was a joke)

Forget it and just don't do it again. By the way that is the easy way to get out of it if some one borrowed money and still own it they can't ask again thank goodness for that.

Lending money is always a bad business unless you are a Shark or Bank or Credit Card Company. Lending money to friends and family is the number 1 reason of destroying a relationship. Collecting on a debt is difficult on someone who is determined not to pay. Best thing is to write it off as a learning lesson and never do it again. Its a Bad Policy and tough life lesson.

she could say she payed you by giving you the playstation. it depends on how much you loaned her. The only thing you could do would be going to small claims court. if you gave her more than a used playstation is worth. one tip is never lend money and expect it back. think of it as a total loss once you give it, even if you DO have an agreement. however that is neither here or there, what is done is done. if you are willing to take her to small claims court then make sure you have gone to several local resale shops and get them to write up the value of the used playstation with all accessories, cords, plugs, memory cards, & games that she gave you. that way the judge will know what to do when your ex brings up that argument and you she can't claim it is worth more than it really is.
