I am wondering what sort of mail was delivered to your son prior to the matter going to collections. It takes at least 180 days for an account to go bad and be sold off to collections. It was serious when the account (which he may or may not have) went 30 days past due and should have been addressed way back then.
First, call the collections people and explain to them that your son is a minor. There will be an investigation into who opened the account in his name, so if you have any information about that, you should share it with the creditor. They can involve the police and pursue identify theft charges, which is what has happened here.
There will of course be questions as to why you did not address this throughout the 7 or 8 previous months.
You may have to produce evidence of your son's age. You should find out the origin of the credit application and find out if there is a hard copy on file. The police will likely need that as well.
The creditor will be able to pinpoint where and when charges were made, what was purchased (or what services were rendered) and if merchandise was delivered, it will be clear as to where.
You're correct: it is very serious. But it's not going to simply get dropped. So be prepared to cooperate to the fullest to get it resolved. Be sure to keep track of your communication, names and phone numbers of those you spoke to, etc. until you are assured that it is resolved. |

Not sure if its the same where you live, but I left home at 16. My mom ordered some things in my name and the collection agency went after me! I photocopied my birth certificate to prove I was 16 and they dropped it because I was under 18 and couldn't be held under contract. Thank goodness. |

Well going on the detail your giving and unless your son magically got a credit card he had his identity stolen. Use this check list it is very helpful and you can try talking to your bank or police they will be able to help if there is more if his identity was truly stolen. |

Minors are not responsible for their medical bills. Their legal guardians are. This is the case in every state, so if its a medical bill in order to preserve his credit you need to call the hospital that assigned the bill to get that straightened out.
Send a dispute and validation letter to the CA (you can google this under "DV letter" for examples). They are legally bound then to validate the debt (which they should not be able to do since he is a minor) If they validate, contact the CRAs and provide them with copies of your son's birth certificate (might be good to fax that to the CA as well, but NOT his ssn!) to prove his age and a copy of his credit report with the debt highlighted (if he doesn't have a pullable credit report the CA has not yet reported the debt, but they will, trust me. You may have to take this all the way up to the Attorney General.
Make it clear to the CA that you WILL sue them in addition to filing formal complaints with the FTC and the Attorney General if this item is not dropped. Make sure you get the zero balance in writing when the account is dropped. Also get it in writing that this debt will not be sold to another CA, otherwise this is going to bounce around from CA to CA for years and you guys are going to be battling this over and over.
If you make them aware of the mistake and they do nothing, you can and should file a lawsuit against them. They are obligated to pay out $1000 in damages for every infraction and that is payable directly to you. That's a federal statute. Keep that in mind and best of luck. |
