If the wife was not a joint or co-signer on the account and they do not live in a community property State like AZ, CA, ID, LA, NV, NM, TX, WA or WI then the wife is not responsible for the debt.

If there is not enough money in the estate to pay the debt the creditor simply eats it.

This will depend on a few factors. In some states married couples accept the debt together. If the husband takes out credit then the wife can be held accountable for it. Also, if the wife and the husband enter into the credit together then both can be held accountable for it. An example would be getting a credit card in both names.

It depends on the state you live in. Some states require that the spouse pay all debts. Other states don't. I strongly suggest you contact an attorney and ask them. Otherwise, you can search online for FDCPA laws (Fair Debt Collection Practices Act) It may take awhile, but you should find the info there. If you can't check with an attorney try this. A card company will not want to tell you you don't have to pay...but if ask them flat out, "Am I required by law to pay my deceased spouses debt?" They can't purposely lie to you.
Also try checking at a local bank...they may be able to tell you the state laws regarding this.

In joint accounts, the spouse almost always has to pay. But if you are an authorized user, you are not responsible if your state law doesn't require a spouse to pay debts.

buy deceased husband plus it not in her name
credit card debt is unsecured debt they cant go after you
or take any thing of yours
