My Mom used my name and ss# to open credit cards...ADVICE PLEASE!!!?
When I was little my mother had TERRIBLE credit (no fault of her own - she cosigned for my dad and he left and never paid the bills) - so she opened up credit cards in my name with my social security number. I am now of legal age but I have never applied for any credit.

Recently I asked her how she was able to obtain the cards in my name without the credit card companies knowing I was a minor at the time. She told me she used a bogus birthday to make it appear that I was of legal age.

She always paid on time and has no negative ratings - HOWEVER my question is if I apply for credit now using my ACTUAL birthdate and real info...what will happen to her? Will the credit bureau find out that SHE opened the accounts like 10 years ago WHEN I WAS A MINOR and have her prosecuted?

The last time I think she actually used a card that was in my name was like 2 years ago...since them mom's credit has been getting better so she has her own cards now. I have access to all the cards BUT I am scared to use them because of the INCORRECT Birthday that is attached to them.

I've seen this a lot in my line of work... A lot of times parents who are pressed for money will put the utilities in their kids names or worse, open credit cards...

Honestly, it will be very difficult for you to get this fixed - especially because of the b-day issue. The credit card companies typically use the b-day first offered with the social security number. Your job now will be to convince them (beyond ANY shadow of a doubt) that you are the owner of the SSN and the b-day you provide is correct... This will take a lot of time and patience on your part. Any credit you apply for between now and then with your true b-day will probably be denied...

If the credit cards are not paid off and closed, this will be even more difficult. You will have to make the choice, do I change it now (which may red flag the credit card company to file charges on whomever is currently paying on the account - because they will have to close it and it is IDENTITY THEFT) or wait and have your parents pay it off and close it (while you can obtain no credit).

Hopefully it's already paid off and closed so you don't have to make those kinds of decisions. If not, that is where you will have to start... Then convince them to change your b-day.... At that point, they may/may not want to open an investigation on "identity theft" for your mom/dad/parents...

But that is the right of the credit companies if they so desire; however, it's a lot less chance if the credit is already paid off. That way the company didn't lose any money and aren't so inclined to put their money out for an investigation in which they would get no recovery money anyway).

Sorry about the situation...that really stinks. Hope this at least helps.

Hopefully she has closed these accounts by now.
Apply anyway and play dumb.
Doubt anything will happen to her since it does not sound like you would be willing to press charges.
If she paid everything off like you think then you might actually have a good credit history.
Pull your own credit report and go from there.
You might have to send a copy of your birth certificate to one of the big three to validate who you are since your old and new birthdays obviously wont match!

The credit bureau won't even notice.

However, your mother needs to get credit cards in her own name and stop using your credit. It's called fraud.

Amber, at the end of the day, your mom should close those credit card accounts because they are fraudulent. And more importantly, these accounts are preventing YOU from moving on with YOUR life.

I am confident your mother had the best of intentions, but ID theft is ID theft. And now that you are grown, she has no right to continue this charade (crime?) at your expense. It's high-time that your mother establish her OWN credit cards accounts in HER name based on her credit history.

Do you see how your mother has made you an accomplice in all of her shenanigans? YOUR MOTHER needs to consult a lawyer about her exposure in this very tenuous situation.

She should be the one taking decisive action to fix what is now broken.

Don't close the accounts if they are still open until you get more info. Closing accounts will make your credit score go down.

I doubt anything will happen to her. You can always call your state Atty General's office & ask hypothetical questions.

Well unfortunately your mother did in fact violate the law. What is the statute of limitations in your state regarding criminal offenses? Also the statute of lims for civil law suits.

Best scenario, since she has her own credit cards now is pay in full the ones in question. Even if an offense has occurred and it comes to the attention of the credit card company it is unlikely they will take any action. Getting paid is what they are interested in. Make sure they are paid, then open your own accounts. They usually don't ask for birth certificates, also important does it show different address. If the ss num hits, and the acct is PIF (paid in full) it may be to your advantage. Most statute of lims on this type of fraud is seven years, but again, if the account in paid in full, nobody will be alarmed. If there is a delinquent large balance out there under your name, and you apply at the address and ss num, hits, somebody might be interested, but then again if that is the case the account may be in a collection agency sold three, four times already. The key is if it is Paid. If paid, I wouldn't worry about it.

Well hopefully they wont find out...and if they do that wont be good they would get it mixed up on what your birthdate actually is. she shouldnt have done that i would make her cancel if i were her...
