Student loans are tricky, they are the kinda debt that really can never go away. They cannot be included in bankruptcys, and are run partially by the government. My suggestion is to call the student loan office and see if he can activate his forbearance. The forbearance will get rid of his current balance and charge him only intrest until the forbearance runs out. its like starting over. They will offer differing terms of forbearance (Mine is 16 months maximum for the life of my loan.) That is the best bet. If that is not an option he needs to get somthing worked out. If his co-signer haad any estate or any inheritance they can legally seize it for the loan. As for him, they can sue him for it. They can levy against his tax returns and garnish his wages. In the long term they can prevent him from being able to own a house, or get any sort of loan what so ever. He needs to call them and get the account straitend out.

he is responsible to repay the loan, his co-signer only guarantees payment if he doesnt pay but since she has passed he & only he is responsible for it not her heirs

They will go after him.... They can't go after someone who isn't around.... What they will probably do is wait for him to get a job(if he doesn't have one already)... and just take a certain amount out of every check until it is paid..

They will sue him for the money an there goes what ever credit he has. They can take everything he owns to pay off the loan. By that I mean everytime you are called into court is will cost you for attorney fees--OOPp I had to sell my car dang law suit anyway.

no, since the co-signer passed away, he now "own's" the debt in full. Regardless of whether he can pay or not, it will go on his credit report and the lending institution will continue to make attempts to collect the debt.
