My cell phone bill and harrassing collection agency?
Ok, i have a cell phone bill from 2005 that i have not paid, and it's not because iam not responsible, it's because i feel this company had been ripping me off, everytime i got my bill and i checked my minutes, it always showed that i used more minutes than i really did, when ever i was on the phone i always kept trck of them so i knew the amount was incorrect, so i just got fed up of there large bills and just stopped and din't pay my last payment, so it went up to $900 and i wasn't even using the phone anymore, that just showed me even more how money hungry these people were, so now 2008 a collection agency started calling me and this woman is incredibly rude, my bill went up to $1700, so now they are sending me letters from a suppose law firm, i don't know what else to do to get this bi*** off my back, i don't have the money for an extra payment right now due to the fact that we're at $5.00 a gallon for gas now.....what can i do about this?

and know that some of you think i was irresponsible, but that wasn't the case, i know for a fact these people were over charging me and it went like that for a long while, i have alot of bills i help my parents and i just can't afford another, the company i had was cingular.

I understand what it is to have terrible customer service. However, if you were standing in front of a judge in a court room, the judge would rule for the cell company. Why? because you signed a legal and binding document saying you would pay!

It would have been better to cancel the agreement with them and pay the cancellation fee.

Now that it has gone this far, you are going to be responsible for that debt. If they sue you they will win!
The question is what is your states statute of limitations on collecting debt? Check that here:

You can send them a "cease and desist" letter that will force them to stop them from harassing you in any way. Find a sample here:

Just deciding to stop paying was a bad idea. You should have cancelled and worked out a settlement back then. And I do believe you about them charging extra minutes. But how do you PROVE it.

Check to see what the Statute of Limitations (SOL), the timeframe to bring lawsuit, is for your state: http://www.fair-debt-collection.com/SOL-by-State.html.

I believe a phone contract would be considered written. If the debt is definitely beyond the SOL, you can send the collection agent a certified, return receipt letter telling them to cease and desist all contact as the debt is beyond the SOL. They have to stop but will probably just sell the debt to another collection agency. You will have to send another cease and desist.

The alternative is to send a letter offering settlement to remove the item from your credit report. Specifically say that you are not acknowledging the debt but are willing to pay $x to expedite removal of the entry on your credit file.

Offer $200 to start. They may counter offer, but you should be able to settle this for less than 25% in a lump sum payment. Get any settlement agreement in writing and keep it, along with your payment proof, forever. Do not give the collection agency direct access to your bank account.

I have been dealing with collections agency for many years. Do not pay; asked them to contact you by mail only.
If they continue calling you after you told them to stop, you can sue them for harassment but, measure you get who, why, when, how and detail of the conversation for your notes.
Do not deal with the collection agency. Dispute the information to the credit bureaus first and after they verify the information send a validation letter to the collection agency asking them to validate the debt. This is your right under the Fair Debt Collection Practices Act of 1977 (FDCPA).
If they can not validate the account they most remove from your credit or you can sue them for defamation of character.

That sux. i bet i know the company cuz its happened to us before also. and i still get calls. sorry for you cuz i know what ur going thru. unfortunately, without paying it, they will keep calling us. i chose to stop answering that phone and got a new number, she just leaves voicemails all the time now. I can't pay them, so I have to deal with it unfortunately :-(

Listen, first of all, most collection agencies do rack up your bill. Why? they want to make it higher so you will make a bargain with them and then still pay what is the original account. If they call you, tell them you it is not that you do not want to answer their phone calls but you only want to discuss the bill with the original creditor. Then, if they make threats to you or what not, then you need to write it down, the time, the person calling and what was said. Then, write a certified mail stating to ceast all of the communication with you. You can check a website on this.It will tell you all of your rights as a consumer.

If you used the phone and didnt pay the last month you still owe the money. If you felt that it was over the limit, then you should've disbuted it. Thats the irresponsible part. Also they have a right to call and ask for the money that is owed.

If you have alot of bills then you should've thought first about it before getting a phone. Its a part of life. Bills live sleep work... bills live sleep work. Even if you change your numbers, they have the right to find you and collect what is rightfully owed. Im not going to coddle you and say you poor baby. You shouldve paid what you felt you owed.. You would have been much better off just canceling the service back in 2005 and paying off whatever the balance was. Now your account has gone to collection, your credit is trashed and you have collectors calling you. What did you think would happen?

When you saw the bill and saw that they were charging for more minutes then you used, you should have called and talked to a supervisor. You can either ignore the calls (hope you have caller ID and don't answer it if you don't regconize number) and hope they quit calling and just drop the suit which they probably won't for a long time..or you make arrangements to pay it. You screwed up so you need to pay it.

-For now ignore them because you don't have the money. I would change my phone number.
-Then if you can you can make a deal with them that if they lower the amount then you will be able to pay it.
-Don't talk to them. The law is that they have to contact you before they go to court and make a decision.
-Ignore and change number.
THEY MIGHT TAKE YOUR CAR AWAY OR HAVE YOUR JOB DEDUCT THE MONEY, JUST GO TO COURT!

GO TO COURT AND TELL THEM YOU WANT A PAYMENT PLAN! OR CALL THEM AND TELL THEM YOU WANT A MONTHLY PAYMENT PLAN!~
