Family or not I would be dragging her butt to court. Studly your a little off track. They can have a police report made, since they know for a fact that a family member got the credit cards illegally that is fraud, and she can be arrested and charged for it. The reason why cops don't want to take a report as you stated is because they dont have the real name or face of who stole your identity, it is like looking for a needle in a haystack. But in this case what is there to investagate? They know who did it. This is a open and shut case. But if a stranger did that then you are right about not holding their breath..
And Studly don't forget your wife used to be a Cop so she does still remember somethings about the law. |

First of all, you need to call these credit card companies and cancel all the cards and get confirmation letters that they've been cancelled. Second, call all the credit bureaus and have them flag your accts. so this doesn't happen in the future. Third, contact an attorney to pursue that she is responsible for all money owed and liable for fraud! Don't sit back and let your credit go bad. If you don't take action - no one will for you. If all you are trying to do is get the police to arrest her, don't hold your breath.
Identity theft is one of the biggest crimes out there. Local police don't have the manpower to investigate all of them. Many times you can't even get local police to take a report.
From their view, you have not been damaged. Your credit is restored, you don't owe on the cards because the credit card company will eat the loss. What more do you want? Besides, they stole from the credit card company, not you. It's their responsibility to pursue it with the police. All your in-law got from you was your identity.
The credit cards have been canceled and/or your responsibility has been removed from this, correct? All you can do for now is place a report with each of the credit reporting agencies that your identity has been stolen and they will place a "flag" on your report. Any future creditors must contact you personally before allowing credit in your name.

This is considered identity theft. She can get into some serious trouble for this. If you filed an incident report with the police, you need to foward a copy to the credit card companies who, by the way are legally required to perform a fraud investigation. You should only be liable for a small amount (maybe $50.00) of each bill,in some cases nothing. |

I'm not sure what you mean when you say you have reported it to the credit card companies.
Here are the steps you must take:
1) File a police report if you haven't already. As some other posters have mentioned they will not probably go after her. But you still need to file it to document that it has happened.
2) Close the accounts immediately. Ask the CC companies to send you a listing of all the charges and that you suspect identity theft.
3) Get copies of all 3 of your credit reports at www.annualcreditreport.com. See what damage has been done.
4) Put a Fraud alert on your credit files. This will be a 90 day "flag" that will alert lender if & when your credit is pulled.
5) Once you have reviewed your credit reports and listing of charges then you will have to start disputing them with the credit card companies. Not an easy task since people open up accounts every day and then attempt to dispute the charges to get out of paying for them.
You may have to contact a lawyer to help you.Since this is a family matter only you will be able to determine how to proceed with your Son/Daughter-in-law.

I know you said its your daughter in law but I would call your local state police and report it there too. If the local police can't do the job maybe you should try the local papers, news stations, radio stations. If enough people start asking why the police have not done their job something might just get done. I would consider this theift. |

Cancell The Cards! if they are in your name you would think that you could cancell them. Also I would make frequent phone calls to the credit card companies to make sure that they are not racking up a bill for you, I would also let the credit card companies know that you have cancelled the cards and you will not be paying the bills. I would also get a lawyer or at least contanct one to see exactly what your liability is in this matter.

I would not not not suggest you do this! It would be funny to take credit cards out in her name and pay off your credit cards she charged to you. Your son would mostlikely in up having to pay for them. All kidding aside you just have to let the system work, as little as it does for those who are victoms to this type of theift. My stepdaughter stolen my checkbook and cashed several checks at checkcashing place. I filed fraud claim and my bank when back on the check cashing place. They filed a complaint against her and she ended up in jail for 7 days. Took several months for me to get my money back. Get the fraud form from your credit card company and dispute all the charges. you will get a credit once the investigate that nothing was on your signature. Then cancell the card in writing. |
