My friend may not be able to pay about $25,000.00 in Visa bills. He has no property, what can they do to him?

OK, lets clear up some of the terrible answers here....

They can NOT garnish your pension or Social Security.

I'm assuming that all of the debts are in his name and there is no co-signers. If so, the co-signer is liable for the debts.

They can not go after anyone else that is not on the card, so the nonsense about going after the daughter's property is silly.

What can they do?

If he has any money in the bank, they can attach to that and empty his account. So have him put money into your account.

If he owes a lot on one card (over $2000) they may try to sue him in court. Obviously it won't do them any good, since he has no source of income or property.

They will obviously place credit reports on his history. I don't forsee him getting any more credit.

Therefore, I really don't see anything they can do to collect.

What you need to do is send each creditor a nice letter explaining the situation to them. There are some sample letters in the links below. When they see that filing lawsuits will be just a waste of money on their part, they will not do it.

The Collection Agencies will take everything he owns (Including his bed) and then they will garnish all his pension and all his social security until he pays off the entire debt or dies.

his debt WILL NOT be "passed on" to his daughter, all she will need to do is contact the companies and provide documentation.
yes, it will mess up his credit, but they will not take his personal possesions. they will call and send letters.

They don't really do anything, they just report it to the credit company and it makes his credit look bad, if he's worried he can file bankruptcy...but they usually won't do anything but send you bills and threats that they'll send it to a credit place...

Well what they can do to him after they sue him is to make sure he never has anything that they can take. After all you cant squeeze blood from a turnip.

I not sure my dad is on social security....they might take out a certain percentage out of his money every month...not trying to scare you and dont quote me on that...and he can make payments of what he can they cant do anything to him while he makes any payment...10 here 20 there everymonth

What can they do to him? Garnish his wages, if he has any. He will never be able to get credit. They may be able to bill his daughter, it depends on what contracts say.

How long ago did he accrue the debt? I was watching Suze Orman the other day on cable and she said that credit card debts have an expiration. After 5 years, credit card companies can no longer collect. They still try to collect money by using collection agencies, in hopes that the debtor will make a mistake like promising sending a payment.

I may have missed some details, so I would recommend going to Suze Orman's website to make sure.

A declared state of bankruptcy can be requested by creditors in an effort to recoup a portion of what they are owed; however, in the overwhelming majority of cases, the bankruptcy is initiated by the bankrupt individual or organization.

The bad side to declaring bankruptcy is that he will probably never be able to have money loaned to him through credit again.
