I am in exactly the same situation with the Halifax - who are a crap bank! They've issued default notices, CCJ's, the Baillifs have even called. They can't have what you haven't got. Don't worry about it, don't lose sleep, they can't do anything even though the threaten and make you out to seem as criminal as a murderer (they've tried the same tack with me). If in doubt seek as much advice you can from Citizens Advice - they helped me very much and kept the wolves from the door. Good luck. |

Phone the consumer credit counselling service for advice - they are excellent and can tell you exactly what is likely to happen and what to do. I will look for the number for you!

You say he has been on a payment plan and has not missed a payment. If the payment plan was AGREED between your partner and the creditor (the bank?) and what you said above is correct I cannot see a reason to go to court or a judge that will find against him.
It may be that the creditor now believes he can afford more than he is paying. They should approach him first and if he refused they could apply to the court for a higher payment figure.
It sounds as though the bank is trying to scare you, as they obviously are doing, but if what you say is TRUE then you should have no fears.
Your partner should write to them detailing the agreement and how he has kept to it. Get somone to witness his letter and send it special delivery (include a proof of postage/receipt). They will back off.

No one will remove your belongings! Just make a new arrangment in court and stick to it. I'm sure things will be fine, it is not worth making yourself poorly with worry. good luck. |

i can only confirm what Les has said. if the payments are being made, I have got to ask are you sure they are being made, no disrespect intended, I can see no reason for court action, does their correspondence give a reason i.e none payment, they want an increase in payment etc, they must have given you a reason. Please do not make yourself ill over this, speak to CAB and try not to worry. |

He will probably just need to turn up at court and make an offer of a reasonable repayment plan. They may want to see a copy of his income and outgoings and any other debts he has. Don't make an offer that you can't afford to keep up. The court will understand if your outgoings and income don't leave much spare. It will just take longer to pay it off. If necessary get some advice from the Citizen's Advice Bureau. It will leave a record on his credit record though for six years which can affect you if you want to rent or get a mortgage. |

Definitely the CAB - possibly consumer direct - (08454 04 05 06).
The extent to which they are calling sounds like harassment - call your local trading standards or the home authority for the bank (I think they are in the City of London)
I am not trying to be hurtful, but have you considered that your partner may not have been entirely truthful about coping with the debt? Some people can live in denial about such problems. |

If you can prove what you are saying the courts will probably reduce the monthly repayment and may suspend interest. If not I suggest you contact an IVA company. Independant are better than the francises. |

Go to the citizens advice bureau. They will back off if they know the problem is being looked at by people who have a good knowledge of this sort of problem. |
