Go to your bank and have your card hot listed. If you don't want to get your friend in trouble tell them you think you saw someone looking at the card but your are not sure and you just want the card hot listed for safety

It's Illegal to use anything without asking it owner. So your roommate would probably go to jail for a day.

How much money are we talking about? My guess is under $200? That is a minor offense. She won't go to jail, and depending on your prosecutor they may not even mess with it. I will bet you they will look at this as a domestic civil problem and they will tell you to file a lawsuit to recover the money.

Are you trying to send her to jail and/or give her a police record? If so call the police and file a complaint. See what happens.

I suggest you just contact the cellular phone place, return the phone and cancel the bill. Learn your lesson about protecting your credit card.

More than likely she wouldn't go to jail, but she will have some fines to pay.

She probably wont go to jail, but she will be taken "downtown" for booking. On a case like this, she will probably be released on her own recognisence (sp) or be pled down to a fine.

Take my advise, prosecute to the fullest extent so you may recieve compensation. I used to work in a store where shoplifters were prosecuted often. Generally, they pled out & paid the fines & restitution to my store. Unless she stole your car, she's not going to jail for any significant amount of time.

only if you press charges for theft, which you should as you don't want to be responsible to pay for a purchase you did not make and will be rquired to file this information with the credit card company to expunge this debt..... who's to say she hasn't done this to anyone else? I really don't think there will be jail time, just a slap on the wrist as it's not a felony.

How do you know that it's her first offense? Just because she told you so?

If anyone did that to me, they would have violated any trust that I had for them, and I would prosecute.

Yes its called theft by taken. She'll probably plead 1st offenders act so she'll get at probation.

I would call the police and have her arrested. Who knows what else she's stolen from you. And you should contact that cellular company that sold her the phone. Its technically stolen as well. Anyone that would do that is not a good good person to live with and is definitely not a good friend.
