My soon to be ex-husband (legally seperated) just filed bankruptcy. Will I now be responsible for the debts?

Yes, you may be on the hook for some of them. This happened to my best friend back in 2001. She finally ended up filing bankruptcy this year. She made a valient effort, but it got to be too much for her. She is now married to a much better man and it was starting to bring down his credit score. My advice would be to consult an attorney. Good luck and I hope things get better for you.

no, bankruptcy no longer eliminates debt.

Yes as long as the debt is in both names or has joint on the credit report. If it is his own individual debts, then no. But if you opened up some credit cards or loans in both names, then you will be tied to the bk. Meaning that if he is making the payments, but doesn't make it on time, your credit will hurt from it. You'll have to discuss this with your lawyer I would imagine to take care of it.

You need to speak with a bankruptcy attorney.
This is too complex to get info over the internet.

If your name was on any of those accts he filed against,
yes they can come after you. My advice-If your name was on those accts.....you might wanna pay them off....or file bankrupt yourself.

You need to make sure you are legally separated if not then you are responsible

I think you will if the debts are in both names. You'd better ask a lawyer.

roxy
My girlfriend just went thru this and in the state of California once you are legally seperated, the debts are individual not joint.

Gypsy Girl
If they were marital debts the companies may start harassing you for the money. Whether or not you are legally responsible for them depends on the state you live in.

INACTIVE
This is not a yes or no answer. It depends on whose names the debts are under, if he got credit before or after you were married, and a host of other questions. This is a job for an attorney who will advise you to get copies of your credit reports from all three bureaus. You may have to file bankruptcy as well or none of those creditors will be your responsibility; however, they may come after you after his case is dismissed. This is a legal issue and not to be taken lightly or you could end up with garnishments of wages, involuntary bankruptcy, or other issues that will mess up your life more than the divorce will.

osunumberonefan
depending on how he filled, you might. See a lawyer.

No, you won't be responsible for the debts. Did you have any type of debt together? If so, it may affect you. But if he filed only debts that are in his name, you should be OK.
