First, lets correct a few of the poor answers here.

They do not arrest you for non payment of debts, so ignore those idiotic answers!

It's not true that only the original creditor can sue you. Collection agencies many times will purchase the debt from the creditor. And even still, CA's are representing the creditor, just like an attorney. I don't even understand the logic of that reply.

OK, will they take you to court? This is actually like a chess game. Each of you must study the other's position and decide how you want to play the "game".

From the creditor's point of view, it's going to cost him time and money. If you live in a differant state, it makes it even more costly, as he will have to seek out an attorney close to you who will do the actual court work. So, unless the debt is fairly large (at least $1000), they will most likely not mess with it.

They will also be looking at other things, such as how will the collect if the win? Do you have a job or property? It does them no good to win a suit and not have a way to collect.

So use this information to set your game plan on how to deal with them. If you attempt to negotiate a settlement, get it in writing prior to giving them a dime, and be sure they put IN WRITING that they will remove any negative report from your credit history.

Only the original creditor can sue you, not the collection agency. Your best hope is that they actually sell your debt to a third party, then you can't be sued.

Yes they can but just try to make arrangements with them and they should work with you and it won't go that far.

Certainly they can take you to court, however, they would prefer to reach some type of settlement; going to court can be quite expensive and time consuming. At first contact with a collection agency, state your circumstances and suggest a settlement of some kind.

it depends on where you live. Usually the company who ownes the original debt sells the debt off to a collection agency for a percent of the original debt. I have seen intenses where the original debt was sold to several different collection agencies. In PA the credit card company/collection agency cannot take you to court unless service was made . That means you have to sign for the Court complaint or an authorized agent must personally hand it to you. Also I have dealt with cases where our clients went to court and a judgment was issued against them and then they filed bankruptcy. Of course if you file bankruptcy under Chapter 7 all of your debt is wiped away regardless if there is a judgment against you

they can, but I think it depends on what type of account and how much you owe. they won't waste the money in court fees if you don't owe them very much.

Yes, I've had a couple go to collection but only MASTERCARD actually took me to court, had to call them and settle it so they would drop the suit. If you're going to make them an offer start at 50% and DO NOT go up.

Not right away, but if you continue to be deliquent, yes they can. If they take you to court it is because they wan't to take part of your paychecks, or take some of your belongings that have monetary value so they can auction it off, and get money for the equipment on your behalf. Those are extreme circumstances, and unless you owe like 10 or 20k, don't worry about court. Collection agencies have bigger fish to fry.

They go to court for permission to take your stuff.

If at all possible, try to work out some kind of payment arrangement with the credit agency. They really don't want to take you to court because it costs them more money and more time.
