I received a letter at home yesterday informing me that one of my creditors is suing me. I'm 21 and a full time college student who lives 3 hours away from home, which is where the case is. The case is also on a day when I have class, which will be a major inconvenience for me. I'm trying to get the date changed, but I can't get anyone on the phone.
I had a good credit history until I got sick(I had cancer) and was unable to keep up with my bills. As a full time student I only work 1-2 days a week and make $30 a week on average. I've tried numerous times in the past to make payment arrangements, but they always bullied me into something that I could not afford, so I eventually gave up paying altogether. I plan to pay my creditors back once I get a steady paying job and I graduate this May. I want to know what they can do to me since I have no income or assets. Also, how difficult would it be to get a continuance? |

Go to court, even if you don't have a lawyer. Explain to the judge about the cancer and your status as a student. He/She may work out a payment plan for you, and if you're lucky, may even dismiss the debt altogether.
Do not just send them a few dollars a month and assume that will prevent them from suing you. Unless you have entered into a payment plan that BOTH parties agree to, they can sue you for what you owe. Then, they can garnish your wages...now and when you get a better job later too.
If you can, contact the courthouse and ask them how to get a continuance. Then you'll have more time to prepare. Take all receipts and documents you have with you to the hearings. If you have any letters, etc. from them, take those along too. If you can afford one, a lawyer would be helpful, but not completely necessary. If you can find a good NON-PROFIT debt counseling service, they can help you too with some advice.
I totally sympathize with your problem. I also became very ill at one point and racked up lots of debt that I couldn't pay off since I couldn't work. But now I (ironically) work in the collections department for a bank, so I know a bit about how this works. And I know from experience.

As for what you can do to protect yourself:
It depends on the state you live in.
Texas, to my understanding, allows for a certain amount of assets to be "judgement proof", that is they can never be seized to pay for judgements in a lawsuit. For the record, it is 60,000 cash, one car and one house. I would have to look up the specific statute, but my Business law teacher said as much, and I trust his say-so 100% on such things.
(more on this later, I have to go, but hold the question open until I can get back to this a bit later today)
Until then, briefly:
Keep calling the courthouse where the trial is set. My guess is that you would likely lose the court case anyways, as you took the medical service but did not pay for it.
I have had some recent uninsured medical expenses as well, so I can add some stuff when I get back to this. Hang tight, it isn't as bad as you might think. |

well the best thing to do is contact the attorneys office and try and make payment arrangements with them - borrow money if you have to. Once you have an arrangement with them they will file the necessary paperwork and delay until resolved or defaulted. Aside of that - having a judgement on your record is pretty bad and lasts for awhile. youll have to pay up eventually .... |

SInce you are not a minor no parent can show up for you. You have to go. You even have to show up for a continuance.
If they win they can garnish your pay once you are working. Are they suing for freud? If they are you need an attorney, if it is just debt you should be able to handle it yourself. |

You can't ignor you problems and expect them to go away. Know your rights. As long as you are making an attempt to pay your bills, there is nothing they can do to you. Send the creditor a check for $5 or $10 dollers. If they cash it, they are accepting that as payment. As long as you send them regular monthly payments, there is nothing they can do to you. Don't ever let them bully you into payments you can't afford! Tell them you will send ___ amount and like I said if they cash it, they have accepted it as payment. It may be to late for this creditor, but if you owe anyone else, call them to arrange payments, don't agree to anything you can't afford, but start sending them something every month!! Talk to the court and see if you can get it continued and then call the creditor and see what you can work out. Even if they say no, send the $5 or $10 anyway and see if they cash it. If they do, keep sending the monthly pmt. and hopefully they will drop the suit. Good Luck! |

They can't take anything you don't have. Inform them of your intent to pay.. If you have no assets or income there is very little they can do if you make a payment even a small one.
Are you independent of your parents? Here in may lie their motive, students in college are generally subject as being dependents. (financially) Your parents could be taken to court, if they claim you as a deduction.
Make minimum payment arrangements, through legal aid on campus. Have an attorney look at it for you. |

How much do you owe? Calm down. Just because a creditor has initiated a suit doesn't mean anything you're sunk. You can choose to not show up at all. The judge will find in creditors favor! Then he still has to collect it. The court cannot force a payment. If it's a lot of money. He can use the judgment to file a motion to attach to assets.
If you want to pay it; start sending a small amount, say 20 bucks a month to this creditor. Then when you get to court, you tell the judge, show your receipts for 20$ monthly payments, and explain to the judge why this is all you can pay right now. It will take all the wind out of his sails if you start doing the right thing.
You are usually allowed one automatic continuance to prepare or for additional ?
You don't say how much, so I'm guessing small claims? under 2500$. good luck. |

I seriously doubt there is much they can do unless it is over a certain amount of money. If it is a small amount like a thousand dollars or so, I'm sure they could work something out. If you tell the judge that you tried your best to work with them, and explain about your illness, I'm sure he will be willing to grant you a little time to pay the debt. If you cannot go to court you could probably have a parent go to speak on your behalf. |
