People that had my phone number prior to me aren't paying their bills?
Apparently the people who had my current phone number are deadbeats and are not paying their bills. I usually get at least a phone call a day including the weekends. I have talked to these people and told them that they do not have the right number. I have told them to stop calling, yet the calls continue. Now I have just quit answering the phone. What can I do to get them to quit calling me?

I'm sorry, but these are terrible answers.

Why does the consumer have to go through the time, expense and inconvenience because some bill collector refuses to do his job???

I can understand their side....many people will lie and give them this excuse. But it's up the the collector to verify it.

Therefore, Mandy B's answer is correct. You must get their address and send them a certified letter explaining that are harrassing the wrong person, and send them a copy of your phone bill.

If they continue, file a police report for harrassing calls, and then file a lawsuit against the collector for the following violations:

FDCA 804.3 804. Acquisition of location information, which says the cannot :"communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information

FDCA 805(3)b (b) COMMUNICATION WITH THIRD PARTIES.

FDCA 806.5 Harrassment and Abuse

Be sure to send your letter by certified mail so you can prove they were notified. There are a number of lawyers who will gladly take this sort of case on in a contingency basis...because they will easily win it.

Have fun with the phone calls for God's sake. Go to the sporting goods store and buy one of those blow horns. Next time a bill collector calls, BLOOOOOW it in the mouth piece. Do this every time. I guarantee the calls will stop soon.

LOL I've had that happen to me and as a matter of fact whoever had my phone number previously must have been a player because all these girls are calling me too and threatening me because I need to stay away from there man. I don't bother answering those calls, but I've gotten collection calls gallore...all I've said was "please take this number off of your list, the person that had this number that you're looking for has obviously changed there number...i am not that person, nor will i ever be that person, stop calling this number".

Michelle H
Tell the collector on the call and then ask for the mailing address for them. Write them a letter stating you are not the person who they are trying to reach, that you got your phone number at such and such a date and to remove your number from their system.

Even if someone is the person they are trying to reach, per the Fair Credit Reporting Act, if you put it in writing that they are not to contact you via the telephone anymore, they legally cannot.

I would suggest certified return receipt requested but I don't think it is necessary. it protects you in case they play the game of they never got it.

This exact thing happened to me, and believe it or not i called them back spoke to a manager, they harrased me a little over the phone with " Are you covering for someone, are you sure it's not you". And after me explaining that why in the world i would be calling them to verify they actually have never called me again. This happened to me last year by the way.

Mr. Vincent Van Jessup
I don't know how long this has been going on for you. but the EXACT SAME thing happened to us. And after about 6 months, it has subsided to the point that we MAY get 1 call a month now, if that. It will get better once the word spreads.

PS -- We had never had that problem until we got a number change. (The phone company told us they recycle numbers, and never issue "new" numbers, so the history of the number you get is a roll of the dice. But my point is, switching numbers may not help, and may actually create a new problem.)

smurfee68
do you have caller ID to identify the calls from them that you shouldn't answer?

how about a call block, or better yet. I'm sure you can call the phone company and give them the numbers and tell them to deal with those people on harassment charges.

what kind of idiot keeps calling the same number when they've been told that they have the wrong number?

orphan annie
We have the same problem, only I have had this number for over 4 years. Bill collectors can use your address to find the people they are looking for. Too bad if it ends up being your phone number that pops up to the address that they have. I was getting the calls for the people that used to live here and I just starting giving them their new address and phone number from they phone book. Eventually, after telling them that info tons of times they have quit calling. Good luck.

You have to be careful with this situation, in particular because if they haven't paid, they probably won't pay, which means those bills will go to collections.

Once that is the case, the ones calling you may be collection companies and those are known to have sneaky techniques to make you acknowledge things that involve you in ways you cannot imagine...

Some phones have the option to restrict certain numbers. Ask you phone company if this is possible. I had a similar problem, and I was able to restrict the number. The next time you receive a call, inform them that they have the wrong number, ask them for their name and their company's name. Keep a list and the next time you receive a call from that company tell them, "I informed Kevin on July 5 that this is an incorrect phone number. If you continue to call me, I will consider this harassment and report it to the Better Business Bureau in your area. Remind them that it is against the law to use interstate phone lines for the purpose of harassing someone."

Start answering the phone, "Domino's Pizza, can I help you?" They'll get the hint and never call you again. Simple, elegant and I've used it when I had other phone numbers in the past.

Narls
Tell the creditors your name & to stop harrassing you for someone elses debt. Then get their name & comapany information. Let them know if the harassment does not stop you will be forced to call your lawyer. That usually works, even for telemarketers.

I've had it happen too... that is a big problem with phone companies trying to recycle numbers.
They are supposed to keep them out of commission for some time, but some still slip through.

I believe the phone company offers a chance to change your number (for free). and explain to the customer service rep what has been happening. Hopefully he or she will search for a 'better' number. And you may consider having it unpublished for some time. There is an extra fee, but maybe worth it for a bit of peace for some time.

The hassle - you have to update EVERYONE (family, friends, your service companies, and more) that you changed your number.

The call is yours....

Mandy B
Either you can take the time and patience to get the collectors fax # and fax a copy of your phone bill with your name as the owner of the number or just get your number changed.

Document those calls, then explain the problem to your phone company and request a number change.

You may need to get your number changed. We had to do that once. Not sure if you can do anything else about it or not.
