Please help someone i know used her dead husbands credit card?
some one i know used there dead husbands credit card and no it's not me, the card arrived the day he died and she could'nt afford flowers or anything for the funrel so as she had a second card in her name she used it after defaulting with payments its gone to a debt angecy and shes finding it really hard to pay them but the debt is in her husbands name so she cant do any thing when they keep putting up the payments. what can i do to help.
please be aware she is an oldely disabled women and was distraut and confused, i know that is no excuess.

You people aren't reading the question. It states "she had a second card in her name she used it". If it is in her name or her name is on the account, she must pay the debt owed. Also, if it was in her husband's name only, a dead person cannot make charges so she stole it from him and is responsible for all charges she made on it. Bottom line is she charged on it and she needs to make some sort of payment arrangement on it.

im sure she loved her husband and everyone knows you only get one funeral...
why not make it nice?
it wasnt like the guy didnt deserve it, he took care of an elderly disabled woman didnt he?

The very least she could do would be get him some nice flowers for his funeral!

if i was her i'd really go all out because im sure he would want her to be comfortable while he is in his eternal rest (lucky fellow!)
she should use the card and get a new plasma tv (its her only comfort being disabled and all)

a new wardrobe, im sure her late husband would have liked to see her dressed nice,

and heck why not used the guys card to get at least one pizza out of the deal! or take the old gal and her dead husbands credit card to subway... only $5 a footlong,

A person Can ONLY be RESPONSIBLE for DEBT if it is in that persons name!!! A person can NOT be held responsible to pay of debt if it is in someone elses name , EVEN if you are married to the other person. That means that when a family member dies, ALL of their debt is written off by that company. My husband has many credit cards that are only in his name, and I have many in only my name, we also hve soem in both our names. Should one of us die, the other can only be responsible for cards in our name , or in both of our names.

Credit card companies WILL try and make you think you are legally responsible, they are sneaky and rotten and they will lie to you. Legally they can Do Nothing!

You aren't responsible for someone else's debt .....after they die ............

The debt is in her husbands name. The husband is deceased. She doesn't owe them AT ALL. She needs to stop making payments. End of story. People are right....debt collectors will say anything. I had it happen to me once, they wanted me to pay my mom's debt after she died. I was young, I didn't know so I started paying it. Well they harassed me at work one day. My supervisor at the time overheard and he used to be a supervisor in collections. He told me to tell them that they were no longer to call me. I have never heard from them since and it was 5 years ago.

They cannot come after her. Even if they tried to do the fraud thing, there is no one to press charges....her husband is dead.

If the card arrived the day before he died, then it was most likely ordered legally and she might actually be a signer on it.

Any charges that are accrued on the card would fall under her husband's estate. When collections are pursued, it follows with the estate. I guess the worst scenerio would be that a judgement is put against the estate and the court would set an amount on how much she needs to pay each month to clear the debt.

I feel very bad for her, but can she file Bankruptcy? Otherwise, she can just keep paying whatever she can on them. Is it possible for you to call these places on her behalf and explain the situation and see if a payment arrangement could be worked out?
