on the 28/06/07 my dad died. he was a pensioner and so he recieved pension payments. following his death we closed his account and all the money went towards his astounding loan payments. however this also included a pension payment. now the pension service want me to pay them this payment back but as im 18 years old and in full time education i have no means of paying them back. i have no idea what do to. they say they want the payment back and they said that bailiffs will be sent round to recover this 80 pounds if i don't pay it back. plz help! Additional Details just to let you know i notified barclays bank on the day he died and they closed the account and prevented all the incoming and outgoing payments.. yet when i went to barclays to say they let a payment in they refused to ackowledge me and said deal with the pension service for paying money in. i have showed countless death certificates to everyone from the pension service and barclays bank. i'm the person who had to sort out the accounts as there is no solicitar or anyone else in my family. |

Surely it's there mistake they overpaid it.
Go to a solicitor ask for legal aid which you will be able to get explain your problem to them and they will sort it out for you including the bailiffs,do not wait any longer do this tomorrow. |

When my brother died, because his pension was paid in advance into the bank before I could notify the pension company, I had to repay also. It has to be paid back, but if you have financial problems seek advice from your local Citizens Advice office. |

I am very sorry you are in this position. I dont know much about this sort of stuff but think you have been offered some very helpful advice here....1) contact citizen advice 2) use some of his assets to repay the money 3) offer to pay it back at an agreeabele amount 4) allow whoever is handling the will to sort it out. I am sure the pension people want their money and so surely working within your means and situation is beneficial to them. I just dont understand why your fathers debt becomes your responsibility upon his death. |

I don't have the answer I'm afraid but get in touch with your local CAB who will be able to give you free advice on this.

You can be held responsible, for the disposal of the pension payment, if you were the executor of his will, or settled his affairs with his banked money, or the solicitor who did so.The bailliffs can only do exactly as they are instructed ,in writing, to do,they must produce the instruction for your perusal.Any claim can only be made against your fathers estate,as he left it.Did you notify the pensions dept of his death ?and supply a death certificate?They will certainly not get any money back from the loan companies and any attempted claim off yourself should be vigorously repelled,see your local citizens advice office. |

they have asked for this because your dad was overpaid.. he should have this money in the bank or where ever it was paid.
If he died the money should be there still.
Update: Im sorry for your loss... this has happened to me. Dont understand why i have been given thumbs down though. What im saying is correct. It will have to be paid back because it was overpaid. That money was his pension money not money to pay a debt off. I suggest you just contact them directly and explain that your 18 and a student ect.. but you can make arrangements to pay £2 per week or something like that. Dont panic though they will help you.....
You will have to explain that the money in his account was used for funeral expenses and that you didnt realise it was overpayment otherwise you wouldnt have used it.
