Pushy debt collectors?
I have been paying my credit card debt each month without fail since being made redundant 6years ago.My first payment was £20 per month but it is now £60 per month.The collection agency is now threatening me with legal action if I dont increase my monthly payments,can they do this?I cant afford to pay any more as I am on a small pension.Any answers please.

usually just a threat as if taken to county court you could tell them you are not earning and can only pay £5 a month so they will lose out.
I would contact CAB (citizens advice bureau) for advice though

Tell them that you can only pay £30.00 and ask for an income & expenditure form to prove it, if they cannot provide you with one, tell them you will report them to the FSA.

At a last resort start paying £5.00 per month and tell them to take you to court, as if they accept the £5.00 payment it gives you a good grounding for making the attempt to pay, and the count court will make a proper judgement that will in the long run assist you.

No, they do that so you can be scared into paying more money. They can't do anything to you if you're giving them money, even if it was $5.00 a month there still getting payments from you. They can't get what you don't have.

They have to accept what you can afford to pay as long as you are paying them back. Whatever you both agreed on paying they can't go back on it and make you up your payments, it has already been agreed. They sound like they are doing something dodgy!!

It is their job to be pushy. The best way to deal with this situation is to tell them to put their requests in writing. You have made payments. You can also ask the Citizens Advice Bureau for a means test form, and help to complete this. Once you have done this, you may find that actually your payment to the credit card company can be reduced, rather than increased. Provided that you keep the payments up, there is no way that they will or can take you to court. Just don't get into conversations with them where they can push you for an increase, when they call, tell them to put their request in writing. You will find that they are a lot less pushy when its in writing than over the phone. Also, request a list of charges made against you since you have had the account with them, as these can be claimed back, and put towards paying off your debt. Most important, don't let these people bully you. You are paying your bill. They cannot get money from you that you do not have. If need be, change your phone number, but keep on paying the bill every month. Deal with them by letter, that way they can't push you into agreeing to something that you can't afford. Good luck.

They can threaten all day long, see if they actually do anything.

The best thing to do is get on a debt management program. See if you can contact the CCCS, as I used to be a debt collector and they were extremely helpful for people in debt back then.

The important thing is to understand that it costs these collectors money to take you to court, and they'd rather not. Just tell them you can't pay anymore, send them proof of income and monthly spending that shows you're paying them all you can and they can't do anything except accept your payments after that.

I had to stop being a collector for this exact reason, some of these people are really unreasonable and bullyish when it comes to collection. Really soul destroying.

let them threaten to take you to court, i doubt if they will. if you've been keeping the agreed payments for 6 years a judge is not likely to be sympathetic to them.

whatever you do never let a bailiff indoors, having freely granted them access once, they have the right to return anytime with a court order and force entry.

the cab can offer good free advice.

They can ask, but if you proove that you can't, then you can't and they can't do ****. Collect evidence now. Bank statements, food receipts, electric bills etc etc.

This doesn't sound right i would get this checked by a proffesional. If you had took payment insurance with your card , the insurance would have covered your payments.
