The collector is breaking the law. Send him a cease and desist notice. If he then continues to call you , you can press charges for criminal harassment. By the way, a debt is not a probation violation. Here's an example of what you can send him:

To:

Date:

Cease and Desist Notice

Re: Account #:______________________

To whom it may concern:

Pursuant to the aforementioned account, I demand herewith a CEASE and DESIST of all telephone calls from your agency, to my home, my place of employment and any other phone numbers of mine that you may have on file. The behavior of your collection agents is in violation of the FDCPA and hence will no longer be tolerated.

Pursuant to the Fair Debt Collection Practices Act:CHAPTER 41 - CONSUMER CREDIT PROTECTION
SUBCHAPTER V - DEBT COLLECTION PRACTICES
HEAD Sec. 1692c. Communication in connection with debt collection
STATUTE (a) Communication with the consumer generally (c) Ceasing communication
If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt.

This is your written notice and if not abided by, a complaint will be filed with the Federal Trade Commission. Furthermore, in addition to filing charges for criminal harassment, a civil action will be brought against you.

Govern yourself accordingly!

I hereby certify that a true copy of the foregoing was faxed / sent on this day of ________, 2007

To:_______________

By the way - if the debt is from the year 2000, it is NONCOLLECTABLE!!! The statute of limitations has expired. Here's a list of the statute of limitations by state:

turn him in for harrasement. since it is close to coming off your report (IF you haven't made any payments at all since then) he will try all means to collect. he probably took a guess as to you being on probation. i do not think a bill collector can get that info. it is already been charged off most likely. if you have made a payment since 2000 then it will be removed 7 years from the date of last payment.

Do not give anyone your checking account info.
Contact the DA of your city and speak to him about this guy. There could be some recourse against him for this.

Credit Companies are out of control now that Bush changed the US bankruptcy laws in 2005....

Anyway arm yourself with knowledge... Read The Fair Debt Collection Practices Act, it is ILLEGAL for them to *threaten* you constantly

WOW this is a new one, OK.. was your last payment on this debt in 2000, if so you don't legal rights it is outside of the time frame where they can win a suit against you. This guy is a scavenger debt collector they bought that debt for pennies on the dollar. This guy is pull all kinds of tricks out of the bag. He probably looked up your court record and is using this against you this is a civil matter. No will not constitute a probation violation and threaten you with that is against the law. I would speak with someone in your court system about this threat. Next time he calls tell him to call your lawyer or probation officer I bet he dosent. Then send him a letter certified telling him he must stop calling you and that this debt is outside of your states Statue of Limitations.
good luck

Yes, you can be sued for non payment of a credit card bill BUT, put in jail I've never heard of that. You can always ask the bill collector to stop calling you at that number and by law they have to stop the calls. AND no bill collector should be harassing you.

As I understand it Discover would have to file charges against you for fraud before you could be arrested for anything.
Contact Discover (not the collection agency) and find out about your account. Do Not give out your info over the phone!
Call your local police and find out what you can do about an abusive bill collector, let them know this guy sounds suspicious.
The only records he could possibly have accessed are those that are on public record and he could have done that just to have something to scare you with.
Trust your instincts.
