Recently had demands for payment from an old debt, not sure exactly how old but over 6 years anyway.?
Had 2 letters, my partner phoned and said the person they want doesn't live here but now have a 'red' letter threatening court action. It was an old debt that I had with a previous boyfriend, unfortunately it was my name on the agreement, so although he absconded and is paying nothing, I've been struggling for years to get it all paid. I've just about got on an even keel, but have literally no money left every month after everything's been paid and need to use my overdraft for food. Haven't had a night out in 4 years, not had a holiday for 10. Not looking for sympathy, btw! :) just stating why this one's stressing me so much! Have a young son so can't cut any more corners. Can they still request payment (the whole amount is just over £1000) or should I dig my heels in? I know I could offer £2 a month or something but I don't want yet another of his debts round my neck for the next 30 years! Any advice appreciated.

If there hasn't been any payments, or communication between the lender and debtor in 6 years, then the debt becomes "Statuate Barred".

This means that although the debt still exists, and you still owe the money, the lender can't take you to court to get the money. They can still chase you by letter or phone, but ultimately because they can't take court action, if you refuse to pay there is nothing they can do

If you have had no contact at all with this company over the last 6 years then no they cant now demand payment. If you have had contact or been paying off the debt then yes they can still pursue you for the money. I think the best thing to do is contact Citizens Advice. Hope this helps.

If it is a genuine debt, you should try to contact citizen's advice bureau. They specialize in helping people and advising what you can do. They are free and impartial and are good with the legal stuff.

If your ex's name is on the debt too, you might be able to get some of it written off or get them chasing him again.

if they have not found you in over 6 years they cant do a thing however if they have periodically traced you in that time sorry they can still demand the money. offer then 4 quid a month

If the debt is in your name it is your debt . So it will be better if you consult with a debt consolidation firm but try to find some which are non profit and are BBB registered organisation. Fill their online form and they will contact you to help you and see what they say.

How ever much you owe, if you have no money then you cannot pay it. Do not ignore the letters but write to them explaining why you cannot pay at once and ask if there is a compromise they could offer you. Suggest and only suggest that such a demand would necessitate that you file for bankruptcy in which case the debt would become less likely to be paid than if they offer you some slack. Another suggestion is to visit the Citizens Advice Bureau. It is free and they are used to dealing with debt problems and they have experts to advise you.

I feel your pain! I had the same thing happening to me not long ago, (I too am a single Mom, no vacations, paper towels are a "luxury item", ect.). Then I finally got quite a bit ahead, and counldn't stand the calls anymore, so I paid off 4 thousand dollars in bills that weren't even supposed to be mine, (don't ever let anyone use your name, unless your prepared to pay when they don't). Anyway, I found out a few weeks later that those debts fell off my credit report less than 2 weeks after I paid them, not because they were finally paid, but because the 7 years was up. That must be why they were getting so ridiculous with the phone calls. I don't know what the rules are where you live, but there must be an expiration date on the debts, and if your struggling, I would try and wait them out if I were you. They can't get blood from a stone, ect. Good luck!

If the debt is in your name it it is your debt. Forget about your ex.

If you are having trouble paying it then say that to your creditors.

Offer to pay £2 per week for ever.

But most imporantly go down your citizans advice bureau as they can help with debt issues.

they are just trying it on, most debt comapnies buy and sell people to try and get the money from you! i know i used to work in debt collecting, if you ignore the letter i can bet a different company will send you another letter about the debt with probably more red writing! after so many weeks you are then sold on!!if it was 6 years ago you would of already been taken to court if they could of so i guess it was a credit card or something in which case, ignore it, i had 1 bothering me for years and when i checked my credit report it wasnt on there as it is unsecured debt - so nothing they can do, to get your credit clear do not apply for anything needing a search as this damages your credit rating, i would go to experian and buy your report 4 £5.99 and have a look on there, i bet that 1000 debt doesnt even show up,i can help you with your debts if you would like to email me with all of your problems i can give good advice thanks wardie4444@hotmail.co.uk
