Recieved a summons from a credit card. I am being sued for the sum of $11,364.24 with intrest rate of 11.990%.
First of all I did not charge this amount. My credit card limit was no where near that amount. I had used the card about 3 times cause about the 4th time when i was going to use it i couldnt find it. I dont remember how long it had been missing. I had went home and called card up and told them it had been missing. They told me I had to write a letter and explain what happed. So I did i thought everything was alright because didnt hear from them until now. there is no way i can pay this amount i am a stay at home mom. Husband is the only income we have. Card was in my name only. How will this affect him. I have no where near the amount they are asking for to even try to settle. We have one income 3 children I cant do it. My husband can not afford to pay this amount for me. please what do i do................

The account for the card was opened in 2003. I found out in 2004 that card was missing lost not sure what to call it. Well i did write a letter to company. I think i wrote about 4 different letters. But the only thing is they said they never recieved any letters. I had all the dates I had called written down, copies of all the letters, I had dates and statements. I am in california and it rained here really hard for days well my yard my garage flooded.
Lucky it had stopped because it had already started coming in under doorway into the house. well getting to the point all my paperwork gone. everthing was wet you couldnt make out anything on any of the papers. I even tried calling up the credit card company to see if they would send me copies of statement of all charges made with the card. And they told me they could not do that. they have no control of the account any more they sold it to another company. I dont remember the dates I have no proof of anything. There word or mine. Google debtors rights for whatever state you're in so you'll have a better idea of how to fight this. In most states, if not all, it's illegal for them to threaten you with a lawsuit if they haven't already filed or don't intend to. Some states also allow you to request a debt validation, which will make them prove you made the charges. Second, contact a lawyer or legal aid. Good luck.

I have a suggestion look these people up I have had clients use them before their a legal advice line for 35 $ they can talk to you about it and for 135 they mess with it.

P.s. The creditors are changing their tune. I know of at least 3 people that received a summons that was delivered via creditor regular mail........ Depends on the dollar amount owed. Call your court house and find out if it has been filed. In addition the creditors are doing what they call " arbitration" That Can also be delivered in a regular mail.

If you received the "summons" from the collection agency, then this is just a tactic to scare you. A 'summons" to appear would be delivered by the Sheriff or Registered Mail and would come from the Court itself, not the creditor.

You didn't mention how old this debt was. If it is past your states Statute of Limitations, then they can not take you to court. They can still ask for payment, but they have no legal precedence for suit.

You can request a "Verification of Debt" from them. Send it via certified mail with return receipt. They will have to send all you the information regarding this account along with an explanation of your rights under the FDCPA.

First, how long ago did you write that letter reporting the credit card missing? Did you get anything back from the credit card company acknowledging the reported missing card? New card?

Second, did you continue to receive monthly statements for the card? Did you contact the credit card company about all those charges on the account that you didn't make.

Send a letter certified mail, return receipt (copies to the collection agency and the credit card company). Indicate that you reported the card missing on ___ . Attach a copy of the letter you wrote reporting the lost card. Tell them you did not make these charges.

You may have an uphill battle on your hands. Fraudulent charges are much easier to handle when they are new. Insist everything be done by letter -- njo phone, no emai, no fax. You need a papertrail.

Definitely check with your local court to see if the summons is real. If there is a court date, be sure to show up.

Get all the facts in writing or statement from the credit card company. Charges that are not yours. dispute with the creditor in writing. keep copies of everything you do. and keep a diary of it all including names times and dates of all calls you make.

You have 60 days to request the credit report. If you dispute an item, the credit bureau has 30 days to notify you and correct any errors. The law was amended in 1997 to add further protections from potential abuses of credit bureau information.

Fair Credit Billing Act. This law protects you from unauthorized charges made to your credit cards or other types of revolving credit. You have 60 days to notify the creditor, which must acknowledge receipt of your notification within 30 days. The creditor must resolve your dispute within two billing cycles, which are usually months.

Fair Credit Debt Collection Practices Act. This law prohibits a collection agency from harassing, intimidating or using abusive tactics to collect amounts you may owe. Collection agencies may not contact you at work if they know your employer disapproves. Moreover, collection agencies are limited to contacting you between the hours of 8 a.m. and 9 p.m.

First of all, get a copy of your credit report, and also your credit card statements, and any charges you did not make, then you need to dispute them in writing. It is possible that you are a victim of identity theft, and while your card was missing, someone was using it and racking up charges. Also, if push comes to shove, contact a credit counseling agency, and make sure it's reputable. I've heard that they can really help you when negotiating debt. I'm sorry you are having such a difficult time with this, but i'm sure you will be able to work something out. Good luck, and remember, if you didn't charge it, dispute it!
