SERIOUS debt please help!!!?
we have debt for the following

Council tax £750 with a baliff company rossendales after going to court demanding money in the next 24 hours else they will come in and retrieve household items

Various Catalogues incl next and littlewoods - refered to debt collection agencies and totalling around £2000

Provident loans - refered to debt collection agency - £1000

Water rates - £500

Rent around £200

We also had a small amount of council tax owed from this year £179 and was taken to court for it last week. we explained we couldn't afford to pay them as we had so many demands elsewhere they took all our details of what we owe and our income-

£25/ wk income support
£80/ wk child tax credit
£30/ wk child benefit

They have set a court date for the 1st of august and have asked us to bring a list of all our debts and mentioned bankrupcy i think they have filed us for it. this is direct from the courts

Will we incur any costs as i have heard of £485 costs online??
what debts will it cover?

The £179 you owe from 2008/09. This is a relatively small amount and they will take an arrangement on it. They will want it paid usually before January 2009. That gives you six months. That makes installments of about £30 a month.

Since you are on income support, ask the council to set it all on Attachment of benefits.

They will probably be willing to do that with this years debt, and they may take back the bailiff debt and set it on an attachment of benefits (AOB).

It's up to them, but it's worth asking.

Also, I am including a link....educate yourself on what the bailiffs can and can't do. It's important.

Looks like you have a mixture of priority (council tax, rent, rates) and non priority debt (loans). Forget about non priority - you can offer them token payments. Get some professional advice! May also be useful to post your question on this forum:

Contact your local Citizens Advice Bureau - they will be able to advise and may be able to stave off some of your worst demands.

1. I think you have to be their when a bailiff comes and admit your name or they can't take a thing.

So she is my sister will do for now.

2. Telephone (if its still working) the bailiff company and tell them you want to solve it and need more time.

3. start tackling the problems

4. Sell all your furnature to a friend for £20.00 and take a copy of the receipt. The bailiffs can't take it if it does not belong to you and you can prove it.

Have you been to see the Citizens' Advice Bureau. They are very helpful and can negotiate on your behalf. I know because I used to be a volunteer adviser.

One if you are claiming income support and and child tax credits you should not have to pay the full rates as the local authorities for a claim form and if someone can help fill it in, I have my doubts but if what you are saying is 100% true, you must write to all the companies explaining your position, include in you letter your total income and all other debts, total up all your outgoings, you may well be able to claim assistance with your rent, if you can not afford to pay anything do not make an offer, you would be better going to the citezens advice and asking to see one of their debt advisors.

I believe payplan are VERY GOOD with helping with this kind of thing.

Stay strong, and (i think this will be frowned upon but i'd do this) if you have anything of significant value (such as the computer your using), get a friend to stash the items of value for you.

Have a TV there still because every house has one, but get down to a charity shop or car boot and buy one from there or ask friends if they have a tv they dont want stashed in the garage for example.

But anything of proper value, get it out of the house.

personally, I think in such cases as very low income, U could gather ALL yer bills & weed out the higher amounts w/ L8 fees. NOW determine HOW MUCH U owed B4 fees were +ed. Pay what U originally owed B4 +ed fees. Pay original amt, NOT fees.

hi,my hubby went bankrupt last year.....only the debts you tell the court will be written off (doubt the rent though) one word of advice though......you will have to go to court an a judge asked my hubby if he was sure what he was doing an then stamped the application....he was bankrupt!!! it does appear in the local paper... but hey if they not talkin bout you its some one else....oh an as soon as you come out of court go to a bank straight away to open another account cus if you leave it till later as my hubby did its a sod to get an account...you will ask yourself if you done the right thing but its worth it just for peace of mind (the best thing we ever did) good luck
