Without more details, we can't even begin to give any advice.

What was the transaction for? Was any type of paperwork involved (check, money order...)?

In small claims court, a contract or promisory note is always very good evidence. But it's not required to win a case. If they judge believes an agreement was reached, then the party you owe can win.

If its a business, yes you will be sued and they will garnish your wages and it will go against your credit

You will not have a crimnal record

If you are dealing with an individual and you have never signed anything, contract, IOU etc, then yes they try to sue. It will be up to them to prove that you owe.

I don't know why a money debt would be considered a criminal act, so I highly doubt you would have a criminal record. Unless you have broken the law.

If they sue and win, yes it will affect your credit record.

If they have 'anything' that proves you had a debt with them, they might win. It's hard to say what will happen. I would suggest trying to work out some kind of payment agreement with them if you cannot pay in full.

sure you can be sued, but it's up to the person suing you to provide proof. I don't think it will affect your credit score. as for a criminal record, you would be sued in civil court, so no criminal record. If you borrowed the money, no crime was committed.

If you have not signed any IOU, there is no legal boundation but yes definitely a moral boundation. This will not affect your credit score in any way but will definitely affect your reputation.

If it's a large amount of money yes. If the person, never said anything about paying back in the beggining, then I guess not. But this can not affect your criminal record or credit report. The only way you can have bad credit for a looooooooong time is if you've gone bancrupt.

Anybody can sue you. Most likely they will take you to small claims court where the judge will listen to both sides and determine if the debt truly exists. If you said you'd pay it, it counts. You don't have to have an IOU, it's a verbal contract.

If you are found liable for the money, the judgment is entered and can appear on your credit report.

The moral of the story is stop being a deadbeat and pay your debts. If you know you owe the money, pay it.

It depends on if they can prove that u owe them & how good their lawyer is. If u are sued , it will be on your credit report but u will not have a criminal record.

They can sue for anything. It is possible to prove a debt without an IOU, but is is harder. This would be a civil case, not criminal.

you won't have a criminal record, but it'll affect your credit report for a long time in a big way

even if you didn't sign something, the other person could prove to a judge that you owe money, but it must be beyond a reasonable doubt...the best thing to do is make payment arrangements and keep them (if you don't, you'll probably get sued and lose)

mmm
he can sue u even if u don sign IOU cos virbal agreement counts and provided he has the money to engage lawyer. if he has a non bias witness, u are at the losing side. this is a civil sue , not criminal act. if the amt is not too big, tell him that u will return the money by monthly instalment. be it, if u owe anyone money, be resposible to return it back.

Bigbilly147
nope you will win they have no evednce on u unless they have a witness

missyghrol
You can be taken to small claims court i think!! Seek advice from a solicitor
