Completely Bored | Should I file a dispute with my credit card company? |
Here's the story:
I ordered ham online from a rather famous store in late April. UPS delivered 2 of 3 packages claiming 1 was leaking so the package was returned to sender.
6 weeks later I have not heard a word from the ham company nor received a replacement. When contacted via email they don't respond.
I can't file a claim with UPS because I was never given the tracking number and do not know their shipping address as its not listed on their website.
So do I have the right to dispute portion of the order? |

Yes. Call your credit card and let them know that you've already tried to resolve this with the merchant but you're not getting any respond.
Though I'd try to call the store instead of sending email and talk to someone before going through CC company. If the customer service number doesnt' work, try sales number. |

UPS claims have to be filed by the sender in any event. Yes, you can dispute it but there is a time limit from the date of the charge - check your card T&C. |

Yes, you should contact your credit card issuer at once. You only have a certain amount of time to dispute, from the time they send you a bill. As long as that hasn't passed, you should be fine.
As a courtesy to the company, it would have been nice to try contacting them by some other method than email (which is unreliable, gets eaten by spam filters, etc.), such as a phone call. But given that so much time has passed, I think you can't wait any longer for them to fix the problem, and need your credit card company to intervene. |

You can tell your card issuer that the merchandise was not received. The 60 day limit is a minimum required by law. Many banks will help you in this kind of a situation even after 60 days. |

Absolutely! File a dispute. You have only 60 days after the charge was made to file a dispute, otherwise you lose your right to.
If you later work it out with the ham company, you can always remove your claim on the disputed item. |

How about contacting them by phone? I'm sure they are willing to rectify the order....if it's a very famous ham company.
There's nothing worse than a spoiled ham. |

It sounds like you did zero diligence. You claim you sent an email, but got no response. Did you telephone them? Send them a written letter? You claim UPS has no tracking number? These numbers appeared on the packages you received.
Sounds like you had a bad experience and because of your lack of follow up, you have little recourse. |
