Should I threaten a collection agency?
I am a freelance writer who has worked for many years and always been paid appropriately. Recently, however, I had a client who has yet to pay me. It has been over a month and she keeps saying she's going to but doesn't. Should I threaten calling a collection agency or will that just make it worse?

Threatening could make your relationship worse so if this is a regular client who has paid in the past then I'd hold off. Similarly, if you threaten but don't plan to follow through, then I'd hold off again, because I think threatening the client with a collection agency probably aren't going to make them want to be nice to you. However, if you do mean it, then it seems to me that it's a good idea. The client might be angry because of the threat, but if they don't pay and you do call the agency, you'll eventually be sure to get your money either way.

That is a threat. If you are going to do it, then do it. Give her a final statement that has the terms and words "FINAL STATEMENT" in big red letters, and on it explain that for every day after 30 days you will add 1.5% to the bill for every day that it is late. If after 60 days time it is not paid in full, it will be turned over for collections.

Definitely don't want to do that. That is called harassment.

If they were able to prove harassment on your part, they could probably get out of paying the bill.

Threaten to call a lawyer and let her know she will be forced to pay all legal charges and fee's on top of what she owe's you if she doesn't pay up and let her know it's illegal what she's doing and it's called theft of service and she can be charged.

There are a lot of legal issues surrounding the use of a collection agency. Hopefully you have some kind of signed agreement. Try a decent free legal advice website.

Send her a reminder that it is past due and if she needs to make arrangements to contact you. Do so and keep copy. Remind her ahain at 90 days and the again after that to say your "accountant" has sent it to collections and it is out of your hands. By then you know that cleint really is not intending to pay for whatever reason especially if you do not hear anything at all from your client.

These are hard times and sometimes silence can mean a lot of different things.
It is reasonable to assume that they (like many people today) are having some financial difficulties. Perhaps a letter politely explaining that you will work with them and accept perhaps break up payments etc. Collections hurt everybody involved and they may or may not recoup some but not all of your money and you''ll have to pay them too. You would be lucky to receive 50% of the money and they will take 10% as a fee if you use collections.
For that, you are better off trying to nicely negotiate with your client if you have the time and savvy to do it yourself.

If you hire a collection agency, you'll take a loss. They'll want a percentage of the money they collect so you'll lose that, and it's usually around 30%-40% or so.

If the bill is large enough and/or you feel she is just blowing you off, small claims court would be a better option.

If you feel she truly cannot pay the money right now, you might be better off working with her on a payment plan.

I can't say I have any experience here, but I would recommend telling her that she has 30 days to pay before you turn it over to a collection agency. That way she knows your serious and she has one last chance before you take further action.

QUESTION; Do you believe the stories she is giving you?? If yes, then you run the risk of losing future business.

If you don't, small claims court is a great option.
