Should i file for bankruptcy?
i have over $13,000 in debt, including medical bills, credit cards, and student loans... my minimum payments each month are averaging just under what i make monthly. i'm barely scraping by and have been forced to move back home to try to catch up on these bills. i was put in the ER quite unexpectedly three months ago, and ever since then, everything has gotten MUCH worse (since nobody was available to pay my bills for me). i'm only 19, and my credit score is pretty much as low as it can go. all of my credit is negative, except for one credit card. soon, more bills will be tacked on, since i still have yet to receive my medical bills from my emergency surgery and 11 day stay in the hospital those three months ago.

i'm aware that once you file for bankruptcy, it stays on your credit for 10 years, and it is the most negative credit one can have. but the way i'm looking at it is, at this rate, i will STILL be in the negative ten years from now because my average APR is 30+% and grows more in a month than i pay.

one more question: what is the difference (or "what looks better") between chapter 7 and chapter 13?

somebody please help. it's 1am and i can't sleep because i can't stop thinking about all of this.

well since i'm living with my mom, you'd think she'd be willing to help me out so i can get back on my feet and move back out... but none such luck.

she has PERFECT, dazzling credit and therefore, a whole lot to lose. she doesn't make as much money as she seems to... so it would be easy for her to get herself in over her head if she did me any favors. i know that i wouldn't screw her like that, but since it's a possibility (although a very slim one) she will not help me. she's offered to open a 0% credit card for me, but the offer expired when i decided to buy my best friend a $30 birthday present last month. apparently to her that means i was spending my money "frivolously" so she's no longer willing to help. she's ALL about having clean credit. that's how i was raised. i just messed up. now i'm stuck and find myself being buried alive.

NO do not its not worth it! You are toooooooo young!!!!!!!
Arrange payment plans for the medical bills...If you are in MI you can even pay them 5 a month and they cant do a thing about it.
First things first. Pay your credit card bills they report monthly. Medical bills just land on your report and arent as negative as an unpaid credit card.

You will have to start paying your debt off, don't even think about bankruptcy. It will ruin your credit for at least 7 years and it may affect your ability to get a good job when you get out of college.

Can you consolidate your debt? I know you will pay more in the long run but for now it can save you from bankruptcy.

First things first the responder who lead you to believe that you can pay $5 per month and keep creditors at bay is very ill informed.

IF you are saying that you also foolishly had no health insurance that means the hospital and all associated expenses will be billed to you? If so you might as well have a consultation with a BK Atty who will go over all your options, 7 or 11 BK and so on, then go from there. You will want to wait and file once you can include ALL those medical bills.
The Student loans will more than likely NOT be forgiven so after the BK you will want to put every dime you make toward those.

Get a second job too.

Mom is right stop spending when you have this kind of debt that lands you back on her doorstep.

13K is NOT that much debt and if you worked an extra job or two for the next year you could easily pay it off but the medical bills are what concern me as those will be thousands of dollars. I do not understand you have not received the bills yet.

I filed in 2002 and I have NEVER regretted it, it didn't stope me from doing anything, for a couple of years I paid a little higher interest on new loans and credit cards, but then I paid them off and now I have good credit. I kept my home and cars.
It was a relief, a second chance, read DAVE RAMSEY, Financial peace university.
Government Loans judgements etc are not removed.
Payday loans, signature loans, medical, credit card debt will go away. The minute you file you will have relief from paying them.

maybe it's not a viable option for you since you didn't mention it, but i think it's best if you borrowed money from your parents to clear those bills first, then work your *** off to pay your parents back.

you're 19, so unless you have unresolved issues with your parents, they'll most likely help you out.

First of all, you cannot bankrupt out of student loans. You did not mention how much of that $13000 was student loans, I am assuming a medium portion. As for the medical bills, you can pay $5 a month and that shoudl keep them at bay for a very long time. When you save up enough money, you can offer a settlement for pennies on the dollar. I ahave actaully paid a $5000 an a $300 medcal bill for $5 each. Over the years, I have learned how to beat the system. It doesn't always work, but sometimes it does. You can email me on how to do that. It is complicated and requires a few letters. Bankruptcy with an attorney will probably cost you $1500. A good paralegal will charge about $600 but you are on your own. You would probably be elligible for a BK 7 which is everything eliminated excet for the student loans. Almost not worth it. A BK 13 if for people that make too much money and don't qualify for a 7 and they will have to make payments over the nezxt 36 to 60 months for a fraction of what they owe. Still cheaper then paying everything in full. If you stop paying on the credit cards, after 6 months, they will be charged off and you will most likely have to deal with collection companies, in which case yousould settle for less that 50 cents on the dollar. I have settled many at 25 and 35 cents. Your mom is right. If you are in this kind of debt, you had no business spending $30 or even $10 on a present. If you was you best friend then he would have understood.

Student loans cannot be discharged in a Chapter 7 filing....so it would be pointless to even consider this...
