Unless you have something in writing, there is really nothing you can do. You can try sending a letter, I regular, !certified stating the unless the said amount is not received within 5 days, other actions may be taken. Make sure you make a copy of the letter. You will note that I said "other actions may be taken", not other actions will be taken. If he calls after the letter is received, tell him you'll take 20% off the amount. In the future, never lend money to friends or relatives because as you learned, they will never pay you back. |

Take him to small clams court! He has established the "loan" by already paying you back. You keep everything "proof" you have. Learn from this and never do it again. People are only as honest as they want to be and no days that isn't much. Just because he hates you he can't break a contrct that you have and with his payment history you have it. |

you may be able to get some help in small claims court w/ a sympathetic judge but that would be extremely rare. unfortunately as far as legalities are concerned, you are out of luck. |

If you can prove that the card was "stolen" then you have about 60 days to dispute it with the card company. |
