khellsee yo | Someone used my credit card and told me they would pay me back but haven't, can i sue them? or just deal? |
An ex boyfriend of mine you'd my credit card to make ALOT of purchases. I alowed him with the agreement he'd pay me back. But has not and it's been over a year! The credit card yes, was in my name. But, when he'd sign the reciepts he'd sign his own name? can i use that to my advantage or just deal? |

Reality Check

You absolutely can sue him. You need to go to your area court house, and file a small claims suit for the damages. If they were for purchases that you were unaware of, or personal purchases he made that you did not authorize or agree to, then yes.
If they were purchase he made for the both of you, for your residence, or anything you both share (or that you still posses), and you gave him authorization to use it...then no.
The judge or magistrate will bring this up, and you can assume he will deny using the card without your explicit authorization for each charge. |

That was a very foolish thing to do. And no, you gave your permission for him to use it. You need to make good on those charges. Maybe next time you'll think twice about this kind of thing. And don't every co-sign for something either! Obviously he got what he wanted. |

Since it is your credit card, you are responsible for paying the credit card company whether he's paying you back as agreed or not.
Even though he signed his own name on the receipts he did so as an authorize user as per your agreement therefore claiming fraud at this point only purgers yourself legally.
You CAN sue him in small claims and make him pay his balance plus your court fees and any interest.
Take this as a lesson learned the hard way. I had to do the same thing except it involved a car loan and in the end I had two car payments and almost destroyed my own credit rating. |

I doubt if you can sue in court since you waited a year. However, you can sent a letter, 1 regular. 1 certified stating unless he pays the amount due in 5 days, you may take others actions. Please note that i said "you may take other actions", not that you" will take other actions". Make sure you make a copy of the letter. If the certified letter comes back unsigned, do not open it because that's the only proof the letter was sent. If he offers to settle for a lessor amount, you should take. Make sure he gives you cash and confirm in written that a settlement has been made and paid in full. |

Your first mistake was "allowing" him to do it at all, even after the fact. You in effect GAVE him your consent. It doesn't matter one iota how he signed the receipts. You are responsible for the charges and good luck suing this guy. |

Small claims court. |

You can take him to small claims court. But you shouldn't have waited a year to do something about it.
Best of luck. |

If he has dumb enough to sign the receipts with his own name, I'd report those charges as unrecognized and unauthorized. The probalem is, if it was over a year ago, then the credit card company probably won't do anything anymore. Try to sue.
And to everyone else, just see how easy it is for someone to use your credit card if they steal it. Tons of places don't ask for ID and don't even look at the signature. |
