Still on collection report after 7 year period (1999)?
Ok.. was reviewing my credit reports and found numerous debts that are passed the "7 year mark", however they still appear on all 3 CRA (Equifax,Experian and Transunion).
What is the process to get the derogatory marks of my report.? Your imput and advise is much appreciated.

You don't mention what type of debts they are. Certain debts can remain on your credit report for more then the 7 year period.The credit bureaus keep your personal credit history for periods between 7 and 10 years:
Unpaid Tax Lien - Indefinitely
Chapter 7 Bankruptcies - 10 years from date filed.
Public Records - 7 years from the date of payment;
Closed or Inactive Accounts - 10 years from the date of last activity;
Derogatory Accounts - 7 years from the date of original delinquency;


If you know for a fact that they are beyond the reporting period, then send them a letter citing the following: Requirements relating to information contained in consumer reports [15 U.S.C. §1681c]

Even after the 7 year mark the credit agencys have been known to leave them on your report, so you will have to send them a letter stating that these accounts are past the 7 years, and you want them removed. Check online for sample letters.

Buddy you just got the best free advice, as all the contributors have given good answers. The problem might be factoring no one mentioned that. These debt buyers, putting debts on credit bureau reports, trying to get uneducated people to pay debts off past the statute of lims, when they go to get electricity turned on. They hope you'll pay the bill, fast, easier than going thru the deletion process, which may take a minimum of 30 days.

You can find on line, sample letters, or if do it yourself, or hire Credit repair, but credit repair honest, not one that says they will get just and legal debts removed-those come back, but there are good cr repairs companies, if you are lazy that will do it for a fee, and you can afford it and don't want to, or don't have time, but this should be easy if what you say is correct.

DAS is correct again. Dispute them with the credit bureaus as obsolete and that should get them removed.

By the way...Misty is incorrect. The 7 year reporting period begins at the date of delinquency and can NOT be reset once the account is charged off, no matter how many times its bought and sold.

Important note: You can request for them to be removed if it's been 7 years since the ORIGINAL DATE OF DELINQUENCY.

You can use a sample/form letter available many places online, or simply write your own professional letter - all it really needs to say is "according to the Fair Credit Reporting Act, the following tradelines are outside of the Statute of Limitations for Reporting, please remove them".

And you'll be sending it to the Credit Reporting Agencies (TransUnion, Equifax, Experian), not the creditors/collectors themselves.

It will help, though I don't know how much difference it will make if they are that old, though if they were never paid, then you may see some jump in your score.

Regular accounts stay on 7.5 years after debt is first charged off. Judgments/bankruptcies are longer. Look at your credit bureau reports. Anything that hasn't "reported" (look at date last reported) in over 3 months will come off if you dispute them. You can dispute on line www.transunion.com www.experian.com & www.equifax.com. Keep in mind it is from the date of delinquency not date opened.

You need to be familiar with the term Statute of Limitations. The previous collection agency that handled you delinquent account basically seeled your debt to another collection agency with RESTARTS the 7 year mark. You have 2 choices: (1) Dispute the credit information through a credit bureau, they will have the responisbility of informing the other 2 bureaus and will temporarily take those accounts off until those debts are really proven to be something that you owe. Creditors will be given 30 days for this process. But hold on, this process can actually take months even years to do. OR option (2) Pay off your debt.
