I owe $3300 from a mastercard that has been bought out by a collection agency. They said if I don't pay a reduced amount of $2500 by next week they will put a freeze on the account and that their client will file a suit against me. I don't want this to happen especially since I work mostly under the table and don't want that to become a bigger problem, but there is no way I can come up with that kind of money in a week. Is there a way to prevent them from filing a suit? I was told that as long as I'm making payments, no matter how small, that they cannot sue, but I don't have a bill or an address to send any payment to anyway. What can I do? |

Take it to Court; they HATE Courts because they interfere with the process of their robbing you blind.
Debt collectors are thieves and conmen - and I mean that in the literal sense - so be on your guard against them tricking you into signing things you shouldn't or being told things that are an outright lie. |

Don't forget these guys are trained to bully people, they usually don't see the money so they use tactics to push you into paying more than you can afford. A lawyer once told me that if you are making good faith payments and they are taking the money, they are agreeing to a payment schedule. They of course will still continue to come after you and harass you, they want their money. If you don't have an address, call them and ask for one or send it to the address you used to use, if anyone cashes your check your covered. I had the same problem come up with T-Mobile, I ran up a cell bill and couldn't pay it off in their time frame so one payment away they sent me to collections, I still mailed a check to T-Mobile they cashed it and the collection agency didn't bother me again. Good luck, and put yourself on a budget! |

It is 100% FALSE, that if you make any payments no matter how "small" that they can not sue you. Until you have an agreement from them for the amount you will pay, any money you send them may be doing no good. If you send some small amount such as $5-$10 it probably won't even cover the interest. Actually, doing this will do more harm. Because anytime you make any payment you have just reset the Statute of Limitations which is their time limit in which they have to file suit.
If they are going to file suit against you, they are going to do it. If you want to try and avoid that you need to make arrangements to settle. But do this in Writting, never deal with them over the phone. Send them a certified letter as to what you can pay and on what dates. Also, put in there that once you pay it in full you want the collection account removed from your report.
If you can't come to an arrangement and they do take you to court, you will eventually be required to show all of your income. If your money is under the table you may have additional issues to deal with. |

OC is correct, follow his advice.
For starters, it's obvious to me they already looked into your credit/finances because they are offering you a discount.
Send them a certified letter with a payment offer. If they accept it, the them to send you a letter of agreement listing the terms, and be sure to make the payments! If they reject it, let them sue. It's unfortunate but you many not have much choice. And note that in most states, the judge has the ability to order installment payments.
As for the under the table pay...they do have to prove it. |

There are a lot of unscrupulous and even illegal things in your story here. Please read and then act accordingly:
1. Your debt has been sold to a collection agency because it was at least 30 days past due. In Consumer Credit, revolving credit issuers (your Master Card) will not usually turn over bad debt until a bill is 90 days past due with no payments having been made during that time.
2. At the time your debt was sold, your account was already frozen. It is not likely that you will be able to use that card again.
3. It is illegal and in direct violation of the FDCPA for a debt collector to threaten you with a lawsuit UNLESS their client has directly instructed them, in writing, that it is their intent to file suit.
4. You can prevent them from filing suit by letting them know that you know your rights under the FDCPA (Fair Debt Collections Practices Act) and state that you have filed a report against them (the agency) with the FCC.
5. You don't have a bill or an address? Wonderful! I'll tell you why - the agency has committed another violation of the Act here in that on Consumer Debt, the agency is REQUIRED to first mail you a 30-Day Consumer Demand Letter - this means that they must mail you a letter stating who they are, who the creditor is, the amount owed, and that letter MUST give you 30 days to respond in case there is a dispute, or so that you can request that a copy of the actual bill or invoice be provided to you. It is their LEGAL OBLIGATION to provide proof of debt and give you your 30 days to respond or dispute.
Further, please familiarize yourself with the Fair Debt Collections Practices Act, which covers all consumer debt collection in all 50 states. Learn your rights and protect yourself. Also when you do make payments on this debt (which I'm sure you will be doing), you would be safer to make them directly to your creditor, and include a letter stating your intent to pay along with a proposition for a repayment plan. They are usually happy to work with you as long as you keep in contact and the HAVE to post payments to your account made directly to them.

call them and make a payment arrangment, ask for an address. If they say the amount you offer is to low, make an arrangment for one higher then that, then pay what you can instead of the amount they want from you. Because they'll try to get whatever they can from you each month. good luck |

Don't worry about the suit thing.....Until a sheriff comes to the door with a summons.
It's just a ploy because the bill collector makes a commishion on the collection if he gets you to pay.
Even if the company was willing to pay the upfront costs asociated with filing and going to court, all that losing a case means is the the state now recognises you actually owe the money.
It is the first step towrads attaching assets, but unless you own a house, they are most likely not gonna mess around with all that cause they know you'll probably just file BK on them after losing the court case (which is unlikely they ever will file anyway). Since your job has some "under the table" qualities, ti is also likely they will never obtain good inforamation on where you work to actauuly "garnish" wages.
Most garnishments are from people who owe child support or other state related debt. The Government doesn't care if you owe Citibank or not.
Tell the guy to drop dead.
Even if you want to pay (or can) ....calll up the original lender and make a deal with them....they can "buy" back the debt and often do. Screww the collection agency.
