State laws differ from state to state, however it's very rare to be summoned for a garnishment proceding that normally happens without you being present. are you sure this isnt the judgement hearing and not a garnishment? also be carefull with the wording a summons isnt an order to appear in court it's an option (IE: if you do not appear you will have a default judgement placed against you, or something along those lines). a Subpeona is an ORDER. if you dont appear after a subpeona you can be held in contempt of court and arrested. it will be very clear in the papperwork what the consequences for not appearing will be. for garnishment law in your state check this site:

depending on your state and income as well as where your income comes from you may be exempt from garnishment all together then you have nothing to worry about. |

The most you can hope for at this point is negotiating with them to hopefully consolidate what you owe at this point and lower your interest rates so you can get your debts paid off sooner. Speak to your lawyer to see if he has advice on the matter that way, which may include working out a deal with the CC company.
Honestly, garnishing your wages is at this point the best thing that could happen to you. Don't run from it. Just deal with it. You were going to have to pay the piper eventually. |

Get an attorney, and pay your bills. If you are summoned to court you have to go or you will be wanted and put in jail for failure to appear |

I have been thru this, if it has already gone to court and they are already got the garnishment in place, there isnt really anything you can do, to stop it, but file bankruptcy! I didnt do that, I just went ahead and let them take it, and got it over with! Good Luck! |

The best person to answer this question is an attorney. In general, if you charge things, you have to pay for them. If you don't adhere to the terms of the credit card companies, they will come after you. |
