I recently bid on a pair of sunglasses, & then realised that they were they wrong colour (I know, stupid. But they were the exact same design & I just bid on it last second...okay, it is VERY stupid) & I meant to bid on the exact same pair but in a different colour.
I contacted the seller & told him of my dilemma, & never recieved a response. Now I've got an automated email from him saying how he expects payment or he'll file an unpaid item dispute.
My question is, if he does do this, what happens to my account? Do I have to pay anything?

Hello, about the eBay dispute problem. eBay won't charge you anything for not paying. Seller do this because they want to receive their final value fees back from eBay, it's a fee which eBay charges when an item is sold (kind of a tax + service as well) but be aware, if you receive 3 of these disputes your account will be suspended until one of them is removed by the seller (so you can't have 3 disputes files against you).
In order to solve this problem with the seller, try to contact him again and write to the seller through the dispute page, explaining again why you didn't pay and ask him if it is possible either for him to send you the other colour even though the item on eBay is the other colour, some sellers would be willing to do it. If not then you could ask for a "Mutual Agreement" with the seller, in this case you won't get a "strike" from eBay and the seller will be entitled to his/her fees back.
In either ways feedbacks can be left or not. Feedbacks can be left anyways. But if the seller cares about their feedback rating, just send an e-mail, saying you don't want a negative feedback, and you would like to solve this problem. And normally they will try to solve it and not leave any feedbacks at the end.

You will get strike for non payment and negative feedback. When you bid, you entered into a contract. You won so you must pay. Just resell them when you get them. Your seller should not have to deal with losing fees, going through a waiting period and relisting just because YOU did not read the auction.
I wanted to add that contacting ebay will do nothing for you. They will tell you to pay. |

OK, so yeah was a bit silly! As a seller I would find this a pain in the ***, but hey, it was a mistake.
You can't be forced to pay for anything, but making a bid is agreeing to a legally binding contract and by NOT paying you will receive an unpaid item strike and neg feedback both could result in sellers and/or buyers avoiding you in the future. If the seller is a jerk - and there is rather a lot of them about he could even take you to court for not paying, BUT that's really unlikely unless you agreed to pay hundreds.
Plus I think by getting unpaid item strikes (I think it needs to be more than one though) eBay may restrict your activities.
The unpaid item dispute is when the seller informs ebay you didn't pay, you are then contacted and have to say you agree to ending the transaction. This is done so the seller won't have to pay the charges for selling the item as the sale didn't happen. He can then leave you neg feedback to 'warn' others that you didn't pay and probably will, but it means you can not leave him neg feedback as technically you were in the wrong.
Best thing I can suggest is to pay for the glasses, you may like them once they arrive and if not can always re-list them on eBay and sell them yourself - never know you may make a bit on them. This way you will have honoured your contract with the seller and will have done the honest thing.
It is really frustrating as a seller when people change their minds AFTER bidding. As I said before you enter into a legal contract when placing your bid, if you don't have time to read a listing completely before it ends it's usually best to walk away - there will always be another one.
Obviously it's completely up to you but I hope you get it sorted.

I think you are obliged to pay for them now - check and see if he has a return policy you might be able to get a refund later. Shame he hasnt replied to you yet - depends what his customer service is like whether out of goodwill he can cancel your bid.
YOu can email ebay and ask their advice too. Good luck - you might have no problem selling hem on again your self though if worst comes to worst.

you don't HAVE to pay him but he will leave a nasty negative remark on your feedback. If this is your first Unpaid Item dispute ebay won't do anything to you but if this is your third the chances of your account being frozen and you being banned from registering any other new accounts is high.
[edit] no ebay won't charge you a fee for an Unpaid Item dispute, it just means that you failed to pay for an item. If you do it 3 times your account is canceled. |

as long as you contacted the seller and told him he did not want the item, then your in the clear, if he decides to go for a dispute, then tell eBay you contacted him and explain the situation, i had to go through a dispute, i also wanted to stop a bid, although my seller did reply, we still had to go through dispute thing, but its OK, nothing will happen to your account if you contacted the seller. have you got a copy of email to the seller? if not don't worry, if he files a dispute just explain what you did.
