Using someone's credit card after they pass away?
My mom is a signer on my step dad's credit card. My step dad passed away and my mom is still using his card. She plans on using it and not paying, counting on the fact that it doesn't matter if his credit gets ruined. So, ..... being that we all know this is legally and morally unethical, ....... my questions is: "Any experience with what ramifications this could cause for my mom?". Hey, I know this is wrong, I do not need any advice on how to handle. I just need to know if anyone has had any REAL experience with what can happen here. What would happen if my mom just ignored all collection efforts and never informed the credit card companies that he died?

As you know it's called bank fraud. Now for the real question, you say your mother is a signer on your late step-dads card, Is she a co-signer or a authorized user?

The difference is a co-signer is responsible for repaying the debt and a authorized user is not.

Even if she is a authorized user, your step-dads estate will be liable for the charges. Which means they could come after any property that is in your step-dads name.

Either way, when the credit card company finds out about your step-dad passing away, and they will believe me, they are going to come after your mom for fraud.

It's called fraud, which means she could pay fines & go to jail IF the company finds out. My sister & mother had that same issue.

as a co-signer your mom is still responsible for your father's debts. Depending on where you live, your mom maybe responsible from a community property standpoint, if your state is community property state. but more than likely your mom's credit will be dinged and if the credit card companies knows that your father died and your mom did not inform them, then she would be liable for fraud..WATCH OUT!!! talk to an attorney about this mess

Since she was married to your step dad at the time of his death, she incurs all of his debts. So, if she's still ringing up a tab on his credit card, her credit will be tarnished if she doesn't pay up. They can and will take her to court to get their money!

if your mom was married to him, she will have to assume all of the debt. If she wasn't married, then they will find video tapes of her using his cards, and send her to jail for stealing his identity.

Your mother could be charged with Bank Fraud, and under the new federal law for identity theft. When the bank or credit card company attempts to collect and finds out your father is deceased they will come after who ever else is on the card. Also they could name you as an acomplise for not reporting a felony.

That would be what we call a Felony known as Fraud. Unless she was issued a card or qualifies for a card on this account.

Is the house, car, and others stuff in his name? They could collect that way, granted, it would take the credit card companies taking your step dad to court and since he isn't alive, they would look at the dates that he "used" the card. They might take his house, or his car to pay off his debt. Either that, or she can go to jail for fraud. I would tell her to stop, cut the card up, and then report to them that he is dead.

have your dad or some other male call in and pretend to be your grandfather and tell them you want to take your mom off so he is solely responsible for the debt. it might even be a good idea to have the male say that he is calling to remove her because he plans on dieing before the card is paid off, that way at least they will have a valid reason to be suspicious of him. When you hang up, boom, your mom is in the clear. Thank you.
