The answer is yes, there are several laws to protect you against wage garnishment. Without knowing more it's difficult to say which one will apply.
However, a lawyer or a legal aid lawyer will be able to help you. In the case of debts occured because of a death in the family, there definitely are laws that will prevent your wages being garnished (one common event is when you have co-signed a loan for the deceased, the law does protect you, but you still need to see a lawyer).
Good luck and best wishes, it's difficult to be threatened with such a thing when you have had a death in the family. The person threatening this must have a heart of stone.
If your wages are already being garnished, see a lawyer anyway, the above answers are wrong, nothing in the law or a legal decision is unable to be changed. Bankruptcy isn't for everybody, but if you are in emotional distress, it may not be such a bad idea. There are two types of bankruptcy, one is a lot tougher on you than the other. Again this is something you should discuss with a lawyer. At the very worst you will live life with no credit, but that is not impossible and for some people preferable. Despite what you may have heard, it is possible to live a full life without credit.
If I can suggest one last thing, having a death in the family can cause distress and depression. There is no need to go through this alone, see if you can get some help for yourself and someone to talk to. Take care of yourself and your needs too. I am sorry for your loss. |

There is a minimum percentage of your wages that you MUST get to take home. Depending on what you do for a living (i.e. my brothers run a construction company), you could be short hours one week, and have a low pay. For a bad week like that you might not have to pay the garnishment that week - but you still have to pay it.
There is a possiblility you could petition the office that is garnishing your wages - domestic relations or the tax office, whoever - to get it reduced...BUT you could also end up having to pay more and be in a worse position than you are right now.
If you owe lots & lots - chances are they'll take your tax refund, also - if you are entitled to one. |

If your wages are geing garnished, there has already been a legal action and a determination by a judge that such a garnishment is legal under state laws. ONly way to stop it is to negotiate with the person who holds the judgement for the garnishment; and they have no reason to work with you.

This depends dramatically on the reason for your wage garnisment. Is it alimony or child support? You may be able to go back to court and inform them that your financial circumstances have changed, in which case they will likely reduce your support obligation. Unpaid student loans? Contact the company about deferrment or other options. As far as I know there is no specific law to protect you from wage garnishment, if your paychecks are getting garnished, it is generally because you didn't do something you were supposed to.
