I am considering seeking legal action against a debt collection agency
called Westcott UK but i'd thought i'd see the opinion on the matter online
first and if you can help.
I myself have never been in debt with this company or the company they are acting on behalf - Provident.
My mother and father have. They do not live with me and have never
lived at my address. In fact I don't even see them. They have not
given my address either. But Westcott have searched Experian and found
that I obviously used to live with them at their old address and now
i'm at my own address and they can't find my parents so they are
sending letters to my address addressed to my parents. They call it a
family link!
Surely this is illegal?
My husband and I have told them on numerous occasions that they have
never lived here but they continue to send letters and now have got a
solicitor firm involved threatening to send balliffs around!
Any ideas? |

I've actually had the same trouble with this company and yet I've NEVER been in debt to anyone. They are nothing more than bullies that seem to find ME responsible for other peoples debts.
I've been on the phone to them countless times to tell them that whoever they are chasing does not live at my address and never has lived at my address so could they please stop pestering me.
Unfortunately for me that only got them annoyed and they took it upon themselves to actually visit my house demanding payment from me, they tried all the tricks in the book but I just told them I'm not the debtor and gave them proof of who i was nothing more they could do.
I think that you should just basically rip up their letters that they post to you, put them back in the envelope and send them back this way it cost them a lot more money and they'll think twice about contacting you in the future!! that's the only thing that worked for me.
I called them to say that whoever they were chasing did not live at my address, I wrote to them but to no avail. I even sent THEM a lawyers letter demanding that they stop pestering me, seems kinda ironic that in the end all I did was rip up their letter post it back to them and they've never bothered me since,

They cannot get your for this debt, however are you sure that your parents did not give you as next of kin? I have used provident and they wanted my next of kin so had to give my parents address. They obviously think if they pester you enough you will give up your parents whereabouts. Send all letters back unopened as they are not addressed to you. Refuse to be drawn into it. If they send anyone round explain that the debt has nothing to do with you and shut the door in their face. |

I used to work for collection agency and I know alot about this stuff.. Next time you get a letter write on the outside of the envelope..return to sender..no longer resides at this address and scratch thru your address and draw an arrow back to the senders address and give back to mail man for him to return it. At that point they should list it as incorrect address and stop at that point. If someone from collection agency annoys you and won't stop then tell them they are violating the FDCPA law and the collector and agency could be sued and the collector could lose his job. Its very serious for a collector to cross the line as they often do. Agencies look for assets to sue people. Example.. they may ask you to write them a good faith check for $5.. That way they get your checking account information and they can then get a judgement and then one day when you least expect it they will drain your bank account. So only pay by money orders.. 2nd thing is house asset they can put a lien on it.. 3rd thing is garnish your wages so never tell them where you work. Make up something.. If they don't have any of the three then you are safe and they can't move forward on u.. |

Write to this company and tell them that if they continue to harass you in this matter, you will take legal action against them. Keep a copy of the letter, and if it still continues then you will have to take legal advice. Address this letter to the Manager of the company. |

Any letters just put as said not at this address and put them back in the post box. If you have nothing to do with the debt then they can do nothing and will be in trouble if they do. If they turn up at the door, tell them politely you are not the debtors. Personally I would contact provident head office and give them what for I had similar from a company over my son and after a few calls it stopped. The trouble is you are the only link that they have to the debt so they will push to see if they can get an address from you. Another tack is to say you have fallen out with your parents and dont know where they are and to leave you alone or you will take it further as you have told them you cannot help. |

Send them a letter telling them you intend to charge them an administration fee for handling and processing the mail they send, a fee of £25 per letter is very reasonable, continue to return their mail with a small letter and insert a invoice clearly dated and explain what the invoice is for, at the end of the month send a statement giving them 21 days to pay, if they do not pay, send them a court action notice and then serve a small claim on them at court, it will cost them a fortune to defend it in the small claims court win or lose they can not claim costs, this will stop them, if they continue send in the bailiffs, it is harassment and you are in no way responsible for debts brought about by your parents, if your parents are in contact with you they should not be putting you through this situation tell them to sort it out if not give the company their address |

If you did not CO-SIGN any of the loan documents, you have NO obligations. The lender obviously cannot find those that owe the debt so they are fishing around for ANYBODY while trying to collect the debt. As long as you never signed, DO NOT WORRY. You are in the clear. |

DCA s are scum, they purchase debts from lenders, banks, loan companys etc.
They pay a fraction for the debt amount and then start hiking it up with additional charges. They only have an inkling of who might be responsible for the debt . They can be avoided but there is a technique to deal with them , please check the link below for any money matters of this nature |
