You do not need a lawyer if the debt is below a certain amount for the Small Claims Court limits in your area. If your documentation is strong and there is a paper trail, you will likely win your case. However, you should also consider how you will collect your Judgment. A half hour appointment with a lawyer will help you determine those best options. |

Do the small claims court route.
If you are not familiar with how it works, do a Yahoo search for "<your state> small claims court". Nearly every state has a website with information on how to file and what to do.
Collecting the the trick. Each state has differant laws. Some make it easy to collect. Others are far more difficult, making even simple garnishments impossible.

You can use e-mail, do this to make the other person acknowledege the debt and can be used in court. Get them to admit in the e-mail the amount they owe you. You can call them, send letters, and stop by their house. Just don't become a stalker or you'll go to jail. If they don't pay, take them to court. |

it is your money, you can call them, email them, and send them letters demanding your money back... do not use profanity, but be direct, you do not need a lawer to go to small claims court, but check the statute of limitation & the maximum ammount that you can sue for in your state. Be sure to bring every shred of evidence that you have to court, and organize it by date. good luck to you! |
