WTF | What are the consequence of having a negative amount of $1,000 in the bank and not paying back? |
My exhubby and I still have a joint bank account. (Big Mistake) Now we have to pay $1,000 on overdraft fee's and money he owes back for insufficient funds. What can happen if we don't pay? At our Credit Union, your account will go to collections and appear on your credit reports. (since it is a joint account, will affect both of you) If the money is not collected through collections, we will then send it out for legal to get a judgment through the courts. This goes on your permanent record. After the judgement goes through, we can attach your accounts at other banks, we can garnish your wages, we can place a lien on your property. And mind you, by this time, court costs, attorney fees and interest have been added on.
Better off if you talk to the bank, ask the to drop SOME of the charges, and pay back the rest.

All i can say is jailtime. There are people in jail for writing hot checks that amount to only a couple of hundred dollars much less a thousand..Good luck,.,,that really sucks to have to pay that back. |

Neither one of you will easily be able to get another bank account for several years -- 7 I think -- because you'll be with Chex. You MAY be able to get a "2nd Chance" account at some banks, but those are restricted I would think. |

Your bank can send it to collections. If it's not paid, they can seize your property (car, home, etc.). You need to get this paid! I'd contact a lawyer - depending on what state you live in, you and your ex need to pay it 50/50. |

You don't have a choice but to pay the money you owed. If this is a join account, you're both legally responsible. Someone has to pay for it, otherwise, it will ruin both of your credits. If you ignore it, it will haunt you.
You can take your ex husband to small claim court if you have enough evidence to sue him. You have to prove that wasn't you who overdraft the account.
If you need lawyer for this advice, you may as well as pay the whole thing off. The lawyer fees will be high and he won't be able to get you out of this one.
When I was married, I didn't have a join account for anything except both of our names were on the house. Thank God that my ex wasn't greedy and was responsible. We both have different checking accounts, credit cards etc.. when we splited, we sold the house, each took the proceed of the sale. All done, everyone was happy. I don't owe him anything and he doesn't owe me anything. We were both able to go out and bought our own home after the divorce. I was pretty fair to him and he was pretty fair to me. No one expected that we ever got divorced but things happened. |

Divorce usually demands separation of financial accounts. Any good lawyer should have informed you of this. Your best defense is to,
1-get your own accounts
2-pay any amount you may potentially owe
3- AFTER you have paid and segregated your finances, then seek recompense from your ex (or other parties), if necessary by legal recourse.
You have very little if any special rights because you are the victim of divorce. At the very least. contact your financial institution in writing explaining and proving your innocence. Offer to open a different provisional account and promise to pay any amount that you actually owe. Document your actual withdrawals and deposits. Make any deposits and withdrawals personally until your situation is cleared up. Do not allow direct deposit during the interim.
Do not ignore a negative balance. In the eyes of the law, bouncing checks or misrepresenting account information is stealing and /or perjury. Both are serious crimes. The consequences will at minimum be suit resulting in you having to pay anyway. You will also have to pay legal fees and fines. The worst consequence will be jail time and destruction of your credit. Both are difficult to recover from.
Separate accounts,
review and document your expenditures,
pay everything that is owed,
communicate with your bank,
seek repayment after you paid,
accept responsibility even if it isn't "fair,"
and document everything!
The consequences for NOT doing ANY of that can be serious. |

Sounds like you need legal advice and fast. The first thing to do is get in touch with the bank manager and have a private discussion in his office, explaining that it was not your debt, but that the names on the account have caused you to become involved. Do not say that you have no intention of paying, since what you need is advice. Be co-operative and listen to the bank manager's recommendations. He may be able to tell you about a charity/voluntary organisation that helps people who are in debt with advice, etc. It doesn't hurt to ask him because he is the one who will know about these things. |

First of all, you will NOT go to jail for a overdrawn account. You will however be sent to the chexsystems and the account will most likely go to collections and can get in trouble for writing bad checks if you do not pay the merchants soon.
If you can not pay them back, then I would suggest opening another checking account asap at another bank and paying the merchants in which you have outstanding checks with directly.
Sometimes in life you gotta do what you gotta do to survive.
