What can I do regarding a late fee for credit card payment?
I signed up for a credit card in JJB sport shop and was told I've about 52 days to make the first payment. I spent about £17 which I paid within this 52 days. That's a while back. Recently the credit company "Sigma Bank" phoned me up and said asked me to make a payment over the phone an amout over £41,85. I asked what this bill consistes of and I was told 2 late fee charges over £20 each plus interest. I said I've already paid the amount I spent before the 52 days time limit. But they said I'd have made the first payment within 28 days which I failed to do. I paid the full amount I spent 3 days later so there was a late fee charge over 20 and another 20 after that. I've never received their bill and I's told They would waive off one late fee if I'm willing to pay the rest of the bill. I said to them they can't actually charge more than £12 at a time and they said that does not apply for credit companies but banks. But They are called Sygma Bank. So What can I do? Help!!!!

What they are saying to you about the fees is incorrect. In April 2006 the OFT capped the fees at £12, and this is the most they can charge (see report below).

If the fee is over £12 you would be able to claim back the difference between £20 and £12, but frankly its not really worth doing. Instead, I would try and use the information below to argue them down.

Regarding the 52 days, I think there was some confusion here. What im sure they meant, is that you don't have to pay interest on purchases for 52 days, not that you don't have to pay at all. You still have to pay monthly, but if you pay off all the transaction before the 52 days, you won't pay interest.

I would ring up the bank and see what they can do for you. In the end, if they waive one late fee, then you only owe £20, compared to if you get them to drop the fee to the correct amount, then it would be 2 x £12 which is £24. So although the £20 is over the limit, you`ll actually save £4 if you pay this.

I'd call them and say that my lawyer said they should waive all but one late fee.
Id also get rid of that card if they are going to charge late fees so often.

I think you have been had. If you don't pay they will screw up your credit if they haven't already. I'd close the account also. There are credit counselors that can help reduce the fees and the amount you owe. I think there should be laws in place to stop these rip off artist.

alatoruk
its 28 days from date of statement, which can be as much as 52 days if you buy the day after your statement is printed.

so legally you was late, and they can charge you.

ok, you might be able to argue the £12 / £20 thing, but then legally you was late with the 2nd payment so they could charge you 2 x £12 = £24. i would pay and learn the lesson, dont take peoples word for it, check the small print yourself.

and is it really worth getting a poor credit history, screwing you for future credit, over such a piddling little amount, that legally is your fault anyway.

On the back of the credit card is a # for either the bank, or a different lender. Call them, and explain everything you wrote here. Usually, as a one time courtesy, most credit card companies will go ahead and reduce or eliminate fees on a billing statement. Granted, it's a one time thing, and they do not do it more than once or twice a year, but it's still worth a try. Good luck!

boojum
Try writing to the newspapers money pages with this, the banks don't like the publicty and if your letter gets published they usually waive the fee

Here's To 2009! =]
Call then and tell them you never received a bill.... you cant pay something you dont know about. Especially since its your first payment you weren't exactly sure of the due date and how much to be paid, etc. Demand them to send you a statement in DETAIL... with when you paid your payment, when you accumlated the late fees that way you can see this. Get up to a supervisor if you can.

Otherwise dont pay it because God knows what kind of bank this is... I've never heard of them. And why is a bank dealing with a JJB Sport Shop cc? If you owed something the cc company would call you, not a bank... the only time banks call you is if you took out a loan or have a car payment, etc.. NOT a cc!

Good Luck!

Before you make any payments first look back on the bill they sent. If it actually says you were required to pay the bill within 52 days and you did then you have a case.

I reckon you've been had - i would get on to the company and ask for a proper statement - THEY MUST ISSUE THIS TO YOU!! I think you'll find it's been a phone scam - you should never just pay something over the phone because someone tells you it's owed!! WHERE IS YOU COMMON SENSE!!

willow
Contact the Financial Ombudsman Service and tell them, Make sure you have all the dates of when you made your purchases and when you made the payments, they will help you and may send a formal complaint to the credit card company. their number is 0845 0801800
They are trying it on as alot of people just pay up as they can't be bothered to do anything about it.
