What can i do about ex husbands girlfriend pulling my credit from her work?
My soon to be ex husbands girlfriend obtained my social security number and pulled a hard inquiry on my credit. She is employed at a mortgage lender, which is where the inquiry came from, although a different associate pulled it (probably had a friend do it). I'd like to nail her ***! Well first of all she/they (her company) have violated the following:
TITLE 15--COMMERCE AND TRADE

CHAPTER 41--CONSUMER CREDIT PROTECTION

SUBCHAPTER III--CREDIT REPORTING AGENCIES

Sec. 1681b. Permissible purposes of consumer reports

Subject to subsection (c) of this section, any consumer reporting
agency may furnish a consumer report under the following circumstances and no other:
(1) In response to the order of a court having jurisdiction to
issue such an order, or a subpoena issued in connection with
proceedings before a Federal grand jury.
(2) In accordance with the written instructions of the consumer
to whom it relates.

Next comes the part where you can sue (both she and all parties including her boss and company.)
Sec. 1681n. Civil liability for willful noncompliance

(a) In general

Any person who willfully fails to comply with any requirement
imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of--
(1)(A) any actual damages sustained by the consumer as a result of the failure or damages of not less than $100 and not more than $1,000; or
(B) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a
permissible purpose, actual damages sustained by the consumer as a
result of the failure or $1,000, whichever is greater;
(2) such amount of punitive damages as the court may allow; and
(3) in the case of any successful action to enforce any
liability under this section, the costs of the action together with
reasonable attorney's fees as determined by the court.

(b) Civil liability for knowing noncompliance

Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or $1,000, whichever is greater.

I think you can call each Credit Company and put a "Security Freeze " on your account. That way they have to call you each time someone asks for your credit.

They are in violation. Just call the company and inform them of what happened. Tell them whoever pulled the credit report should be fired immediately or you may take other actions against the company for allowing an employee to run your credit report without your permission.

If you and your husband have an existing mortgage/loan with her company with your name on the loan application....then they could always say that it was a routine inquiry on your credit file.

If this is not the case, then this is a major violation of the law and your privacy......Unless your ex-husband's girlfriend can come up with a confirmed application that authorizes her to pull your credit file, she's in deep trouble.

The ball is in your court for how you want to proceed here....You probably have enough info to get her fired....It's up to you if you want to open this door....A divorce can be a horrible, long and protracted process....Think carefully before you pursue this action....Specifically, do they have the ability to retaliate if you take this action? If there are children involved in your upcoming divorce...take particular care and thought before making a bad situation potentially much worse.

Address a registered letter to the manager in charge of the mortgage lender threatening to sue.

an institution must obtain written permission before running a hard inquiry against your credit. what she is doing is illegal and she is putting her whole company at risk for litigation. i would report her to her manager, but make sure that you have documented written proof of what she is doing and handle things in a calm manner. you don't want to come off as accusatory or beligerent.

If you don't have a mortgage there or have not applied for a mortgage with that company, I would nail her butt big time. Find out who is in charge at her office, send a registered letter and copies of where it shows the hard pull on your credit report, and ask for an explanation.
