What can you do about a collection agency calling for different person?
Colection Agency continuously calls for my father on my home and cell after I repeatedly prove it is not me and give details where he is and yet they still call. What grounds do I have and what all can I do to stop this.

I have told them where my father is in Nova Scotia, Canada and also the Do Not Call List is for soliciting not debt collection so that is no help, but thanks.

They are not allowed to do that but they all do it.
What you need to do is to tell them you are recording the call then tell them this isn't his number and not to call.

Tell them they are in violation of The Fair Debt Collection Practices Act . If they keep calling then contact the FTC (1-877-FTC-HELP).

Tell them if they call you again you will get the police involved.

Or if they call, just do whatever the hell you like - hang up, sing a song, tell jokes, recite poetry, ask them to wait, and then leave the phone off the hook for half an hour.

I have the same name as someone in my town has skipped on her bills for several years. Just recently received yet another call from a bill collector.

Before I engage them, I ask them to tell who they are, their phone number and where they're calling from. Once I'm comfortable I know who they are, then I use the last 4 of my drivers license to emphasize I am not the person they are looking for.

Some don't want to believe me, since my listing is in the phone book, but most get the idea that I can't help them. When the caller provides you with all the company contact information, finish the call and then call the company and talk to the head of the company. Emphasize harrassment is not only illegal, it also is unprofitable.

i am a collector for credit cards. i am here to tell you that you can stop it. call the company that is calling you..tell them that you will sue them if they do not remove your # from their system. By law we have to remove the # from the system. we also have to respect the card holder at their place of employment. my company calls them at work...it's ok if the card holder agrees. but by law they cannot keep harrassing you trying to reach you dad. call them and tell them ONE more time. if they call again honey you can sue them. good luck to you!!

Wednesday, you are really starting to piss me off with your crappy collection agent answers!

BULL! As a former collection agent you KNOW BETTER!

And the rest of you who answered! DO YOUR RESEARCH!

-The do not call list only covers solicitors, not collection agents
-The police will not get involved because no law has been broken. Don't waste their time.
-The FTC won't help. Their job is to track complaints and they will only get involved if there is repeated complaints, and only in a regulatory manor. They will not assist individual cases, as the remedy is already stated in the laws about what you can do.
-Why change your phone number? That's stupid!

OK Class, lets once again open our textbooks to the Fair Debt Collections Act...(See Below)

So what do you have to do to get this harrassment to stop? Have your FATHER send the collection agent a cease and desist letter, and specifically not to contact you again. Send this letter by certified mail, return receipt.

If you get another phone call from them, you now have grounds to sue them for $1000 in small claims court.

Trust me, once they get this letter you will not hear from them again. If you do....well just pretend you won the lottery, and file your court case. You will easily win. But you MUST follow the procedures in the FDCA in order to have a case.

1st you might want to change your ph# if this is too much hassel then get hold of your congressman and next time they call advs them that you are working w/the congressman since you are on the do not call list also you might want to call all three credit bureau and sign up for do not call lists too..

Get their address and write a stop and desist letter to the highest manger whose name you can get. Call them and tell them if they continue you are going to sue for harrsssment. If that doesn't work ask your dad to change the phone number.

Contact your local police and report it as harrassment. Call the phone company and have the number blocked.

File a criminal complaint in the nearst police station or ask the inspector or officer to take the call see then what happens. You must inform police about harassment, personal intimidation, pschcological warfare are being let loose on u by the collection company. Ideally do it with a lawyer.

He can send them a formal cease and desist (the majic word)letter, or try to tell them verbally. If he does not want the calls and can not help them, there efforts are not worth the trouble. No you on the other hand have to deal with the calls and hopefully make arrangements with the company.

Join the do not call list and if they keep calling, report them.

If your state has a no call list, sign up for it. Also, tell them you wish to be removed from their databases immediately, as you are not your father and you do not wish to be a reference for him either. Tell them if they do not comply, it is in violation of the no call list, or alternately, that you will call the police and file a report of harassment as soon as you hang up the phone, with a lawsuit for harassment to follow soon after. If this doesn't work, then actually do the above, or tell them where your father is, or change your #. Have you tried call blocking?
