Katherine D | What do I do If I paid off my debt with a collection agency, and they're telling me that I owe them money? |
Northland group, a collection agency, mailed me a letter out of the blues saying that I owe "CHASE" $3,600. I had paid off this debt at least a year and a half ago. I never recieved a "settlement letter" stating that I paid off the balance, but I also never called the collection agency to followup on it. I did my part by paying what I owed, and I thought everything was good. Now they're saying that I owe that huge amount and that they just took over my account 3 months ago. I asked them, who was handling my account before you guys did? How come you guys just, out of no where, bill me right now? How long has my account been closed? They could not answer any of my questions. All they said was, you owe $3600 and you need to pay it. I told them I'm not paying anything because I've already paid off what I owed, and the debt collectors never sent me a settlement letter. Another collection agency was handling my account before Northland Group,but I don't remember the name. |

Find out the name and call them. Also, call "CHASE". It shouldn't be too difficult to clear up because agencies such as these keep paper trails a million miles long. |

If you never got a letter stating that your debt was paid off, can you produce bank statements that show a history of cancelled checks that total the amount of the debt? You will have to produce some proof of payment if you want to dispute the charges.
In the meantime don't keep talking to these people. They won't answer any of your questions. They are programmed to demand payment, and that's all they'll do if you talk to them. |

I'm sure you paid by check or money order - both of which are records of payment. Contact your bank to retrieve the canceled check for proof. In the future - always get a payment in full letter sent and keep all records of conversations (date/who you talked to/what was said) and keep all receipts for TEN (10) years. Also contact all three credit agencies about this issue and tell them your side of the story so it does not effect your credit. |

You need proof that you paid the debt send copies not the originals so if the copies get lost you can copy more I don't know why you didn't get a settlement letter from them but it may have been an oversight as they were getting ready to make the change over to this new company but you still have the upper hand so long as you can prove you paid the bill I don't know how you paid the bill but if it was through the banks you will have it on your statements or you could ask the bank for a copy of what you paid and to whom but for gods sake don't let go of the original document saying you paid |

You need to find some method of proving that you paid this off already. I know that you said you paid off the debt a year and a half ago. Perhaps you have bank statements that can help.
Also, contact your credit bureaus (there are three you can get for free per year, per the law) and tell them that you dispute this if it has shown up on your credit report. Also, your credit report may already indicate that it has been paid off previously. I assume the new, third party who took over the debt and has incorrect records.
A friendly note, it is really good to get these free credit reports (don't get the scam ones...do a google search for free reports, it's a great law they passed) every year to keep your eye on stuff like this.

Don't talk to them on the phone. Send them a certified, return receipt letter telling them to cease and desist all contact. Indicate that the debt was paid in full a year ago and that you have proof of payment.
For future reference, you should always get a written settlement agreement BEFORE you pay anything to a collection agency. You should then keep that agreement, along with your payment proof, forever. This situation is exactly why. |

It sounds like your account is in the hands of "junk debt buyers".... and, that's what they do -- bill you "out of the blue"!!
I suggest you (1) go to www.BudHibbs.com and learn about "junk debt buyers". (2) Call or visit the websites of state and county social service organizations, the state attorney general, or the state bar association and ask where you might get FREE legal aid.)
At NACA's & Bud's site, you will find samples of "Cease & Desist" and "Validation" letters. THEY must prove they own the debt; you do NOT have to prove you don't. They can not contact you after they receive the C&D letter. (Send it Registered Mail... with a signed receipt returned to you, if you can afford to.)
If you click on "Agencies to Avoid" at the top of Bud's pages, you will find a long list of unscrupulous agencies. I did not see Northland there, but maybe they also do business under another name. Feel free to e-mail Bud and ask any questions you have.

Next time they call tell them to send you everything in writing that you will not deal with them on the phone. They'll ignore you at first and continue to call. Become a "broken record". Don't say anything other than "I will respond when you send me your information in writing."
If they send you something . . . then check with an attorney who has experience with collection agencies.
In the mean time get your free credit report from Uncle Sam (and only from Uncle Sam. so you won't be scammed, spamed or solicited for business.) to make sure there are no derogatories as a result of the "unpaid" debt.

If it doesn't appear on your credit report then the collection agency whos dunning you has an unverifiable claim and they more than likely will not send you anything.. If it does appear and you have some proof of payment then you'll need to get the error removed from your report.

When you originally paid this debt, did you pay Chase directly or did you pay the collection agency that was handling it? Did you settle this debt or pay in full?
First, you need to pull your credit reports to determine who and what is reporting. It's possible that the first collection agency is still reporting.
Second, you need to send Northland a certified letter stating you are demanding validation of this debt, as you believe you had already paid it. Demand that they prove you owe this debt as well as disclose who they bought this debt from. You can find sample demand to validate letters around the internet. If you can track down the original collection agency, try to get a letter stating the debt was paid.
You might consider joining the forums on Creditinfocenter.com and Creditboards.com. There are many possible scenarios that could have happened and there are very knowledgeable people there who can help you further. |

You have thirty (30) days from the date of their letter to file a written dispute. Be sure to send it to them Certified Return Receipt so you have proof that they got it. Include a copy (front & back) of the check with which you paid the debt. They can't take any action while the dispute is pending, and since you already paid the debt, they should go away. If they don't, there are further steps you can take.

get the mane of the origional collections agency through Chase... they will have it on record who they sent the debt to... ask the origional collections agency who they might have sold the account to (if they say that you paid them in full, then refer back to the bank... obviously at this point the bank had sold the debt to two collection agencies |

How did you pay them? check? Look in your old bankbooks or call the bank if you know what month approximately it was. Contact the former collection agency in person if possible, they will take you more seriously. They will have records. Contact Chase and tell them the situation, in person if possible. |
