What do you do if someone gives you a check and the check came back NSF and there account is closed?
I received a check and I had deposit it and it came back NSF and I cant get in touch with the people and there accout is now closed, what do I do?

Cliff P
WHat was the check for? Did they make a purchase at your business?

If it is local and the person is still in your state, then the police can help. If they are out of state, the local DA cant do a thing.

You can also report the check to a check verification company like Cross-Check, Telechek, etc.... These places carry a database of bad check writers. They can add this person to their database, so that this person doesnt get another business.

You've been scewed. Never accept checks from strangers.

Get ahold of the prosecuter. If they can find this person you may be able to get your money back. This is the reason why no one likes to take a two party check!

If the account was closed prior to them writing the check, it was fraud.

Track them down somehow, and tell them you will report it to the police if they don't pay you in cash. Then make good on your threat if they don't. They should also repay you for any NSF fees your bank charged you because of their bad check.

You could always attempt to sue them in small claims/conciliation court, but that's a last resort.

Writing a check that bounces isn't necessarily illegal, though it can be if there's a pattern of non-payment, or no intention to ever make good on them. Writing a check against a closed account is check fraud, and it is a criminal offense that has consequences.

You can go to an attorney and have their paycheck garnished. It all depends on how far you want to push it.

Kaska
Depends on how far you want to go. How much is the check for?

startwinkle05
First, I would contact your own bank to see what they suggest. They should know best how to deal with this. I imagine you will have to file a police report. If the check was over a certain amount (it varies), that person could be facing a felony charge.

waynesdaman2004
Well if you can't get in touch and there acct is closed you've basicaly been robbed. It was a what we like to call a rubber check. It was real and not real. I would call the FTC (Fedral Trade Commision) and report a fradualnt check.

What they did is considered a federal offense. Call the law on them. You may never see your money, but they should end up in prison.

depending on the amount, you have options. 1.report it to the police. 2. you can inform the bank in writing, and request last known address. 3. if the amount is large enough, contact a lawyer

bryan l
depends how much the check was, even so if it was small call the local police and report it, looks like a fraudulent check case. Larger amount i would contact your attorney.

No matter what the amount was for you can take them to small claims. Of course you'd have to be able to find them, or at least a decent address. My county has a website (total invasion of privacy) where you can type in a persons name and see parking tickets/ court hearings and just about anything else you want on someone. Does your county have something kike this? If so it could be of use.
