Do you think debt collectors want to hear something like this
"yes, I know about that debt I have and I'll pay you $400 right now, here is my account number and ..."
or do you think they honestly want to hear the truth that you can't pay anything since you do not have any funds or you do not have any funds put away for that bill (due to you paying your mortgage, your car payment, your car insurance, your gasoline, your food, your ulitities etc....so you can continue to work, eat and live).
Second question.
I've had debt collectors ask if I have any brothers or sisters that I could "borrow" money from (I'm an only child) and they go on and on asking if I have friends to help me out.
Now, I know this goes against their FDCPA rules But what they DO with the information once you tell them that you do not know people like that? Do they write it down or something?
I'd answer them honestly-I don't have friends that can help me with money, they have their own bills! Additional Details One more detail. I don't talk to them anymore. Once in a great while I get a phone call. Writing a cease and desist with the FDCPA guidelines works every time! |

There is that joke about "What you say..." and "What they hear...."
You say "I don't have the money"
They hear "I got the money, but I'm not giving it to you".
You say "I have no money left after buying food, gas, cloths, insurance....."
They hear "......and movies, Starbucks Coffee, football tickets, 42 inch tv....."
You need to understand what a collection agent is. They sit in a boiler room of an office with a couple dozen people and make phone calls. They get nothing but excuses and no offers to pay.
Then there are people like American who responded previously.....it's amazing they can walk without tripping the way they strut with their noses stuck in the air. Some day he will find himself laid off...maybe a medical emergency destroys his finances....maybe a divorce is in his future.
The fact is most people who fall behind on debts fall into these categories and had no choice. But collection agents see them all as deadbeats.
Just do what you are currently doing...send them a letter to quit calling you. |

Their job is to get money from you whatever way possible. All they want to hear is that you can give them money, or things that make them believe you are likely to give them money in the future.
I've found that lying never particularly helps. When I didn't have it, I'd say "I don't have any money, you are welcome to call back in a month. In the meantime, you are free to pursue any legal actions you wish, but be warned that I make below the minimum amount for judgment and have no seizable assets, so you would be wasting your time and money."
If I did have money, I'd say "here's how much I can send you right now. It isn't as much as you want, but it is better than nothing."
And to the poster directly above me: I'm happy for you. But don't think for a moment that your finances are ever completely secure. Things can happen. You can lose your job unexpectedly and have trouble finding another. You can get medical bills above and beyond what your insurance is willing to pay. You can never predict the future enough to guarantee that you will be able to pay all debts. Even people with perfect credit occasionally default. |

The only thing collectors are interested in is getting paid. They don't care that you don't have the money or have other obligations. The only reason they ask about relatives or friends is to suggest you borrow money so you can pay them.
Cease and desist letters will stop them from calling. But they are probably selling the debt to another collection agency. If your debts are within the Statute of Limitations (SOL), you might end up with a court summons. Some collection agencies are going to court for smaller amounts. |

what works even better is to pay off your debts as agreed.
I never get collectors calling me. But, oh I guess i pay my bills as agreed to and don't take on mofre debt than can afford. Silly me. |

I don't know about debt collectors, who are usually employed by companies specialising in collection when the debt becomes a bad one. They probably have their own agenda and take a twisted delight in their job. In fact, their agenda is to get the money out of you by hook or crook, never mind that you are merely transferring your debt to someone else.
I do know that the companies to whom you owe money are often happy to listen (to you or, better still, a debt management advisor) if you have a debt management plan and agree to pay off a certain amount each month.
By far the best advice I can give is that you go for debt management counselling. Check with your Citizen's Advice Bureau (a free service) who will advise where to go. DO NOT respond to advertisers who will claim to handle everything for you (for a fat fee ... where do you think the money comes from for all that glitzy advertising?)
A responsible debt management counsellor will, of course, want an honest account of your financial affairs but the information will be confidential between you. They will generally charge a small fee which will be fully explained to you and factored into the plan to get you debt free. A recognised counsellor is worth that fee because they have far more clout with the companies you are in debt to, who are far more likely to accept a regular payment plan from them than they are from you.
Be proactive and set yourself a goal of being debt free in X months. It can be done with help, and you will be surprised, at the end of it, how easy it was. Then you can be like the person who pays off all his bills ... at least, until the next crisis hits, but by then you'll have a little more experience of how to work things out. |
