What happens if my truck gets repossessed?
I put a truck in my name for my bf at the time(my ex now) He made all the payments for a year so I had no problem with keeping the truck in my name because he had bad credit. But now, he is in prison and can't make the payments. I can't afford to make the payments either so I am thinking about letting it go back. I have tried to sell it with no luck, I owe more than what it's worth. I live in NC and was wondering what would happen if the bank repoed it. I know that my credit will be ruined, but can they garnish my wages?

But can the bank garnish my wages? I know I will have to pay the difference, but what happens if I don't pay it? I read somewhere that in NC they can't garnish wages unless its for taxes or child support.

Auto finance is what I do for a living and this is what will happen, the lender will sell the vehicle at auction for less then it's worth and come after you for the difference including all fees for repossession, towing, storage, reconditioning, lawyers, interest and anything else they can think of.

If you do not pay, they will take you to court and get a judgment, you are correct that in the State of North Carolina the only things that wages can be garnished for are government services and taxes, but what they can do is attach bank accounts and file liens on any other property you may have like cars, boats, land and homes.

All of this activity will show on your credit for the next 7.5 years making it very hard to get any other types of loans without paying huge fees massive down payments and State maximum interest rates.

Sell it for what you can get and take out a personal loan for the balance, this way your credit will not be trashed.

A vehicle loan is secured debt. If the lender repossesses it, they will sell it. What usually happens is that it is sold for far less than the outstanding loan. YOU then owe the balance. And yes, if you don't make payment arrangements with them and repay everything on time, every time, they will hound you unmercifully every day from 8:00 am until 9:00 pm.

I dont know what NC laws are on garnishment but I seriously doubt it

I know for sure that the only agency that can garnish your checks is the government (ie: student loans, taxes etc) but not creditors....that's in my state of Texas!

I think the worse case scenerio is that they will repo the truck, sue you for the difference of sale of the vehicle

It depends on the bank. What happens is the creditor will usually sell it to a collection agency or attorney's office. Usually but not always if it is sold to a collection agency, you will be ok. Attorney's offices are in the business of garnishing people's wages. My mom works for one and they are hard core when they go after your money. They will add on attorney's fees, late fees and fees that you have never heard of along with high interest to the balance and you will probably end up owing more than you borrowed in the first place even though you gave up the car. If you are going to let it go back, just pray that it doesn't get sold to an attorney's office. Otherwise I would suggest to try to keep the car to avoid all of that headache and sell it later. If they repo it then they sell it and you have to pay the difference in the price they got and what you owe plus fees. If you don't pay the difference they can take you to court and garnish your wages.
And once that repo goes on your report bye-bye getting credit for a long time. You need to do everything you can to get the money to pay the difference. Extra job, sell stuff (boyfriends stuff..hey he's in prison he doesn't need it *LOL*).

I think I'd do whatever I could to not let it get repoed. Talk to the bank too!!

No, only reasons that you can get wages garnished is Child support, IRS (property taxes and county taxes included), and student loans, go to FTC.com and search for that.

The repossessed vehicle will be sold at auction. The difference between what it brings at auction, and the amount owed will still be your responsibility. There is no such thing as "letting it go back" and yes they can file for a judgement, and garnish your wages for the above mentioned amount.

My guess is you'll get have bad credit and not they can't garnish your wages. unless you owed to the law or in that nature. like child support or the government or you were sued.

THEY CANNOT GARNISH YOUR WAGES.....Here is how it works, you dont pay...fine!!!..they will try to contact you to try to work something out... IF they dont... You NEED to contact them... and try to work out a lower payment.. Sometimes they will let you pay what you can... keep in mind they LOOSE money too if you dont pay...IF you dont contact them... LOOKOUT because they can take you to court.....
