They just called me at work, saying that they were going to file a complaint and then asked if I had an attorney. I told them that I didn't have the money for an attorney and that I didn't even make enough money last year to file taxes. I make under a thousand a month. I lost one of my jobs. They said they would settle if I could come up with $1000.00 in two weeks. I'm so stressed..I want to cry. Then they kept asking if I had a family member or a credit card I could charge the money to. I said no, my dad's on disability and my mom doesn't make enough money to help me. What should I do? What happens if they sue me? |

Inform them not to call you at work and if they continue to do so you will file a complaint, it is against the FDCPA Law (Fair Debt Collection Practice Act). They only ask you if you have an attorney to try to scare you into making a payment or pay in full. They can ALWAYS settle on an account in collections (they won't tell you this), your best bet when you are ready to pay on your account you should contact the agency which has your account towards the end of the month(like the last 2 days) and settle on your account and don't give in on the first settlement they want to offer you. I had an account which the amount owed was $75,000.00, when I contacted the payer towards the end of month(it's when we offered the best settlements) they ended up on settling on their account and only paid $5,000.00 to settle in full(debt taken care of/off credit report/paid in full status). They only ask you if someone can help because some people do have family members who are willing to help them out (like parents who just might have come across some extra money themselves). The bill collector is just trying every tactic that they know works sometimes when mentioned to people. All states are different as far as them suing you, some states don't allow it others do, you have to check as far as your state is concerned, also if they can sue you they can only take up to like 15% of your income(most cases is lower, or they don't follow thru with it). They are just so hard on you cause they have their managers in the background screaming at them to get them money, they don't care who it comes from! The average debt collector calls about 300 people a day and only talks to about 10 people, so out of them 10 people they just want to get 1 payment. |

Suze Ormond said that by law they have to stop calling you if:
You send in a certified letter requesting that they stop all calls.
Although I suspect that this will only let them send you to court that much quicker.
The certified letter is your proof, that they are breaking the law. Make a copy of the letter and keep that mailing receipt.

Sweetie, do not worry about it. Tell them not to call you at work. Once you ask them, it is against the law for them to call you. If they do, report them. Try and mail them a payment each month even if it is $10. Or you can quit payment all together and over time they will write it off. Unfortunately it will cost your credit. Do not stress over it, it is not worth is. Every thing in life is temporary. Hang in there. |

In the state I work in, them calling you at work is harassment and against the law. It could cause you to lose your job.
Credit card companies always threaten. If they sue you, then worry about the outcome then. |

Wow calm down. It is illegal for them to call you at work, or harass you. They are getting the exact response they want from you. Tell them that you know what they are doing is illegal and that you are going to report them to the attorney general and better business bureau and be stern like you know what your talking about! I doubt they can sue you' It depends on how much you owe. But there are guidelines, like the court has to leave you with a certain amount of money to live by. The court prosess takes forever anyway. The most likely thing to happen is the annoyance of the phone calls and some bad credit. It will be allright! |

You should not be talking to these people.....the only reputable company in the US that helps people in credit card trouble is Consumer Credit Counseling. You should call them ASAP! |

Tell them to not call you at work, you will get fired. Then tell them that it is against the law for them to harrass you. Take you to court. If that ever happens and it usually does not, offer $10. a month (if you can). Do not get all upset about it. They can sue you but it is so costly to you. I owed them $5000.00 and I currently pay $25.00 a month on agreement.
When they sue you they contact a lawyer who gets a court date. You can settle before then though. It takes years for this to occur. |

If they sue you - they will probably get a judgment against you. They will sue for the money owed and their fees.
This will mess your credit up.
The judgment is good for 10 years.
If the debt is only 1000 - they probably won't sue. They are more likely to sell the debt after a while to another collection company. They won't spend 5K to get a 1K judgement.
But -if you need a legal opinion - follow up with an attorney. |

I've looked a little into this company and it sounds like they have some questionable practices. It seems like a doctor (usually a dentist, but it can be anything) confronts you with a large bill and offers this card as a way to pay things off in installments with little or no interest. The company is hard to reach and charges fees that people don't believe should be charged. They claim payments are late to justify interest rate increases. In short, this doesn't seem like a very reputable company.

Honestly, you may have a legal case against the company. Tip number eleven states:
Complain about abusive collection practices. Under the federal FDCPA, a collector is not allowed to make idle threats, express or implied (for example, "We must get your payment no later than the day after tomorrow"), or use abusive or profane language.
This sounds a lot like "Pay us in two weeks or else." If the collector has no intent to file a suit, this is against the law. The second source below (about lawsuits against collectors) quotes someone as saying that if the debt is about $1,000 the threat of a lawsuit is probably not real. Honestly it wouldn't be worth the time and money in those cases. Still, don't ignore this. Read through the tips on dealing with creditors and follow through with it. Most of all, don't panic.
