Chapter 7 is a proceding whereby your non-exempt assets, if any, are liquidated, and a trustee pays the net proceeds to creditors, while your debts are discharged. In general, this case is for a person with no disposable income and no non-exempt assets.

Chapter 13 is a wage-earner plan to pay some or all of your debts from disposable "current disposable income" as defined by the bankruptcy code, payable over a period of 5 years. You would use chapter 13 if you have non-exempt assets you want to protect or if you are not eligible for chapter 7 because of your income level.

Either way, it will be on your credit report for 7-10 years.

There is an 8 year wait between chapter 7 cases.

There are lesser waiting periods between multiple chapter 13 cases.

There are substantial penalties/problems for getting your filing wrong, so be very careful or get some professional help. Look for a board certified consumer bankruptcy lawyer at www.abcworld.org.

A Chapter 7 completely absolves you of all debt you claim under the bankruptcy plan by liquidating assets and any remaining debt. You never have to pay it back. It usually takes about 3 months to discharge from the date of filing and, from the discharge date, you are not allowed to file another chapter 7 for another 7 years. A chapter 13 is a reorganization plan- you are not completely getting rid of it but instead putting the debt into a trust situation where payments are made to your creditors under different guidelines. These plans can last years, but do not have restrictions as to how many you can file in a given timeframe. Once you are discharged from one, you can file another at any time.

Either one will stay on your credit report for 10 years from discharge. Neither one is "more acceptable" to lenders.

Chapter 7 of the Bankruptcy Code governs the process of liquidation under the bankruptcy laws of the United States. (In contrast, Chapter 11 governs the process reorganization of a bankruptcy). Chapter 7 is the most common form of bankruptcy in the United States. An individual who is badly in debt can file for bankruptcy either under Chapter 7 (liquidation, or straight bankruptcy) or under Chapter 13 (reorganization).
