What powers to creditors/ court have to find me? Please i want people that know what they're talking about.
I have asked 2 questions that maybe haven't been specific enough, please dont give me answers like they'll find you. I need someone that knows what they're talking about..
Im in a lot of debt, if i moved away, and changed my name, started afresh, no links on the credit file. The only thing i cant change is my national insurance number. If my creditors went to court, they have my national insurance number from loans, and my old employers details, but ive since lost my job and im unemployed at the moment. Could they find me by my national insurance number? Can the court find where im living by that? Do they have access to Department of Working Pensions, (inland revenue) details, and what they hold on me like my new address etc. What powers to the court/creditors have to find me?

Its yout debt, so pay it. Goto Citizens advice. People like you are who puts the charges up for everyone else, I hope they catch up with you sooner than later, coz thay WILL eventualy.

It doesnt matter how many times you ask this question, the answer will always be the same.

They can track you down, whether you move house , change your name, move country. What ever you do, they know about it.

Just declare yourself bankrupt

Ok now for some practical advice.

Been there, done that, got the tee shirt.

First of all, almost all financial companies carry an insurance policy against non payment of debt.
DDifferent companies have different criteria to reach before there insurances will pay up.
They must prove that they have taken all reasonable steps to try to trace you, including applying to the courts for attachment of earnings (which would also involve a search of your NI number and how and where it is being used.

In my own case I went to South Africa for 12 months pretty much for the same reasons you have mentioned.
On the day I returned I went into a well known high street bank and opened a current account, applied for and got a credit card, and to this day have not heard from any of my past creditors.

I am not saying you have to do anything as drastic as leave the country (though it does help).

If you intend to remain unemployed, go one step further and find some work which pays cash in hand.
Do not sign any official documents, Cheques, electoral register, on line surveys, savings accounts, official letters.

Do not answer to any contact attempts from creditors (as soon as you respond to a contact, the absence period starts afresh),
Do not answer telephone calls etc using your own name.

Eventually, the debts will be paid out by the insurance companies and the debt either written off or sold to a debt collection agency whi will only attempt the same tactics but with a stronger tone.

You get the idea?

Now there will be those on here who will slate me for saying all of this, that it is wrong and not morally the thing to do. However, those of us that live in the real world know that there is a point where you can see the rest of your life tied down to a never ending debt which is never going to be fully repaid and all it is doing is stopping you getting on with the rest of your life.

The finance companies are making billions on behalf of the fatcat shareholders, it is the shareholders who are forcing up the financial costs and probably the shareholders who will knock what I have written.

So what.!

If you can stand to live at your witts end for a while and have no credit, cheque book, bank account or savings account then go ahead and do it.
If however you can see yourself not being able to live with looking over your shoulder constantly, then take out an IVA and pay it off at a few pounds a week.

Play it there way and you'll be broke forever, take the plunge and at least have a fighting chance to recover, the choice is yours, millions of debtors are doing it already but are not going to own up to it.
Thats probably why people on here will read this with such shock and horror, but it is common place.

Hope this helps and apologies in advance to anyone who doesn't agree with it. There again, these same people probably agree with opening the doors and letting this country be flooded with foreigners taking the benefits and housing. But thats a different subject.

running away is not the answer it will always be there to haunt you take control of your own life again did you know that even if you pay back 1 pound a week you cant be touched because your trying ignoring them and running is how you get in trouble your seen to be making no effort like stealing so you can be brought to court all they want your still paying them and trying start lodging a small amount every week and you will be OK they will eventually work out some deal more suited to you definitely running is not an answer for this you will forever be watching your back

The answer to your question is YES they will be able to find you from your NI number - eventually - if you can hide for 6 years - the debts alomost certainly be cancelled -

well they have only to look on yahoo answers and there you are stating your gonna change this and that and run off on debts we have tried to advise you but seems the bottom line is you have no intention of paying what you owe.............stand up to it pull your head out the sand you ran up the debt now go some way towards paying it back

it becomes very tough to just disappear, give this some thought, what if you just dropped out and then you found a job some where and fingerprints were required? if you use a false social security number what will happen to you when it comes time to retire? don't you think it would be better just to work out a deal with your creditors and pay them a little each month? that is unless those you owe are not legit?

Courts have unlimited power to access any and all information possible to trace you, and once they do find you four things will happen.

1. They'll relink all your financial history to your new details.

2. Your creditors will lump on a ton of interest as you've not been paying and will instantly apply to send the bailiffs in - and then you are in BIG trouble.

3. You'll get a 'gone away' notice placed on your credit file - and that the singly worst thing you can get - its viewed even worse than a CIFAS fraud warning

4. You'll probably be prosecuted for fraud.

Oh and i hope you've not registered your details on your yahoo account as i'm about to send your question (and user name) to both Experian and Equifax.

I have answered you in the past and I know what I am talking about. My friend got his sister to join the tax office so that she could obliterate his file - she left in two weeks. My point is that when people will go to levels like this to get what they want they will find where ever you are but it does depend on how much you owe. I am sure I could find you from your National Insurance number and it would cost me under a hundred quid to do so and probably nothing. The court won't bother unless you are a criminal as well. Creditors have no special powers to find you but when people are owed substantial amounts of money they will find ways as I have done and many times. You may be lucky but why not make an arrangement with creditors and pay off some of it for it isn't right to do what you are hoping to do and escape paying

Unfortunatley the court can apply for an attachment to earnings order so even if you change your name ect.. they can still find your employer through the tax office. however even though you are in money trouble, find your local Citizens Advice Beauru and get some advise most debt can be written off if you can no longer afford it.

I don't know what powers they have in finding you but theres no point running from it. If you try to speak to the creditors and tell them your circumstances then they might lower the payments or wait until you get a new job.

You cannot get money from a man of straw. The court will take into account that you are unemployed and might make the creditors lower the payments each month or freeze them until you get a job. I take it if you were planning on 'disappearing' then you don't have a mortgage so have you thought about declaring yourself bankrupt which will clear the debts?

It's not down to the courts to find you but the creditors may have their own solicitors which might do that for them.

It's either face up to the problems or face having baliffs coming round to take your possessions.
