What should I do about crediters threatening legal action?
I haven't been able to pay any on my dell account this last year.. due to the fact that i'm a college student and don't have alot of money. I was planning on paying the debt off this summer, bc i'm gettin alot of loan money. However, a creditor keeps calling sayin that my attourny needs to contact him. I was just concerned. Is he probably BS-ing? I won't have the loan money til next month, just not sure what to do about the creditors now. Any advice?

dont avoid your creditor. talk to them and try to arrange to reschedule your debt. I am sure they would also like to have a win-win situation rather than to have you default on your debt.

With a credit card - you can just ignore the creditors - as it is unsecured loan.
With Dell, the loan is secured by the computer oyu purchased. If they are being asses, you may feel like telling them to come and get their computer. Otherwise, just tell them your situation. Offer to pay a small amount on it every month. Normally what will happen is they will threaten you for awhile (consider getting caller id) and then they back off completely. You have already ruined your credit by getting behind on payments, so they really can't threaten that against you.
I went through a similar situation a long time ago. They eventually quit calling after about 6 months, then they started sending offers - that if I would pay an amount (usually about 30% of the total debt) they would take that as full payment and call it good.
If you get loan money next month, you should be able to get caught back up.
Just explain the situation and see if they will work with you - otherwise, just ignore it. There really isn't anything that they can or will do.
Usually the threats get people to pay - if they can.

They don't care if you are a College Student or if you don't have a lot of money.

I suggest you to sell everything you have (Including your bed) and pay them before you get in trouble.

By the way. There are no College Loans for Criminals.

He's bluffing (hopefully). Call him back yourself and tell him you'll be able to pay off the debt next month.

First, remember that collection agents will lie to their mothers if they can collect money that way.

I need more info before I can advice you. This the person who is calling you an attorney, collection agency, or some third party collector? If so, they must follow the Fair Debt Collections Act.

If it's a representative from Dell, they do not fall under the act, and can pretty much do what they want. You just have to do your best to ignore them or work with them.

Second....GET ARMED! He's doing this nonsense because you don't know the law, and don't know your rights! Are you aware that if he says he's going to sue you, and does not follow through, he may have violated the Fair Debt Collections Act?

Read the links below and learn the FDCA and the Fair Credit Reporting Act.

Will he sue you? That depends. Where do you live and what state does the creditor live? They will not spend a lot of money trying to sue you from several hundred miles away. They would have to hire a local attorney, and that eats up their profit. If the debt is under $500 it's safe to say he's bluffing. Over $1000 they may sue if they have a local lawyer or collecter they work with.

If you plan to pay this debt off, get IN WRITING before you pay them a DIME that they will remove any negative credit report listings from your history. Without that promise, your credit will have a negative report for the next 7 years. Your only leverage to prevent it is your money. Once they have it you lose all negotiating power.

I don't know why your attorny would need to contact them, Dell will probably turn your account over to a collection agency if there's no payment. Then you'll have to deal with the collection agency directly.

I would call and speak with a manager and explain your situation. Make a payment (any amount that you can) and try and arrange a payment plan. Unfortunately, you can't just ignore the debt until this summer even if you're just a student.

Also, I'd get a spell check machine, too if I were you.

They can really mess up your credit record. I would try to get professional help. Try to strike a deal, offer less to settle the entire account. Get to a Credit Counselor.

Talk to the creditor and tell him your situation if you send them 5 buks a month or agree to any way they wont bother you for a while
