What should I do about my situation with being a co signer?
I had a girl friend for two years. We were engaged. she lived with me for about 6 months. We broke up about 5 months ago. When we lived together, our budget was tight. so I refinanced her car loan so that the interest rate would go down since I have great credit and she does not. Well, she will not pay the bill so I have been paying it for the last 5 months because my credit is good and I dont want it to affect my score. what can I do. and dont tell me Im stupid. I already know that!

You can't do anything but keep paying the bill and, eventually sue her for the money. That's why you don't co-sign.

If the title and loan is in your name only, you have every right to pick it up. Just make sure you call the police in your area once it is picked up.You'll have to give them to make, model, year and vin number. I would not tell her what you're doing because she might smash up the car just to spite you.

If you refinanced the loan, then the car is now your property, so you need to get it back, especially if you are making the payments and you two are no longer together!

To keep your good credit rating you have to make the payments. Take her to small claims court and start getting your money back.

Well not to be brutal but since you co-signed and the car is also in your name would take it. Call the police have them escort you and say you are retrieving the property you own, and are paying for. Your name is on the title so there is not thing one she can do. You are the part titled owner. Then tell her she can refinance in her name or not have a car. If you do not have keys you can have them made and take the car as stated you are on the loan and listed as an owner

If you became the legal borrower of her car, you are stuck with the bills if you don't want your credit score to go down. But if you think you can rebuild your credit score after defaulting on the payments, you should. Announce to her that you will stop the car payment, she has to do it instead, and that if she doesn't pay, she will be facing a Repo-Man.
Let the loan default and have her car repossessed.
Meanwhile, keep your other revolving charges and debts paid off regularly. The best way to build up the credit score is to paydown 90 to 100% of the revolving balances. Your score could go up 70 to 100 points if you did this consistently.

Grandpa
first take the car back and then sue her in court for the back payments fore what she owes you for the amount

The only thing you can do is pay. You're right about the "don't tell me" part.

Not sure what state you are in.
Is the car in both of your names?
NOt sure what you should do
this is a hard one
how much longer do you have to pay on this loan

after checking the laws in my state,

I would probably (cause I am a bit more mean) take the car and place it in a storage locker and keep making the payments if I was co owner of the car.

Tell her you will give it back when she makes them
let her take you to court and explain to the judge what is going on.
get copies of your payments ready with you to go to court

I am not sure where you live and it might be illegal to do in your state so be sure to check out the laws on joint ownership to be sure

But at the very least since you cosigned it is your car too and since she has not made the payments then it is not fair that you should have to

another option would be to chalk it up to the school of hard knocks

she did you a favor by leaving
(that free creditreport.com commercial comes to mind with the guy that lives in his inlaw's basement wishing he was a happy bachelor with a dog and a yard)

Go to the loan originator and explain your situation. they will be able to tell you if they can contact her to ask her to refi again. Otherwise, if the car is in your name too, tell her you are going to sell your share of it to see if that wakes her up to the situation. You may be powerless to do so but she may not know that. Also, you can tell her that you are going to stop payment on the loan and that you want to turn the car in. Otherwise, he credit which has been improving will once again be in the dumper. don't try to be logical with her; she's not listening.

Well, sounds like you've learned your lession - we've all been there.

Your name should be on the title to the vehicle if you are a co-borrower, hopefully you did that.

Usually, its best to try and "put on your happy face" contact the girlfriend and explain that "we" need to sell the vehicle or refinance it into just her name, so which would SHE prefer to do? (giving her that choice makes her feel less threatened or following an order - but both outcomes solve your problem equally well). Even if you both hate eachother, if you can work out a friendly solution, it would be best.

If she does not co-operate and your name is on the title, your juris diction may allow you to take posession of the vehicle, although do not count on it. If your name is not on the vehicle, or reposession is not an option, then small claims (assuming it is less than $5000 in most JD) is probably your best route after deterimining she will not otherwise cooperate.

you are correct to keep making the payments, any missed payments will adversely impact your credit. If the vehicle is titled jointly or in your name, you may also have further liability if she causes damage to any other party using the vehicle.

good luck. and remember, people who have bad credit - have bad credit for a reason, and 99% of the time that reason is they make excuses and do not make good on their obligations.
