What should I do if the billing department keeps harassing me?
I was the passenger in car accident last February. i went to the hospital to get checked out and I was fine but just for looking at me and taking an X-ray cost 277.00. The insurance company of the guy who caused the accident paid the hospital bill. he hospital claims that they needed paperwork to process it meaniwhile they reported me to a collection agency. Back and forth I'm going with these people faxing proof of payment and what they asked for. Finally last month I thought finally it was over. I just received a letter that they moved my account to another collection agency and next month they will report me to credit bureau. What can I do to get them off my back ..physically go down there and stuff the proof in their face. I really feel like doing that this has been going on over a year.

The advice to call the FTC, or your Representative or Senator....please don't waste your time. What a crappy bit of advice!

Not sure what the insurance company is doing, start by calling them and get info.

But you did say you have proof the bill was paid, so lets go along that angle. Paul M is correct, you simply need to read the Fair Debt Collections Act and the Fair Credit Reporting Act.

Follow my instructions....I've played this game before and it will work for you.

Send a "demand to validate" letter to the collection agency. Use the sample letter below. By law, they have 30 days to send you proof that you owe this debt. That includes contracts, bills, receipts, and everything used to calculate what they claim you owe. Also include a cease and desist notation in the letter so they stop calling you and bothering you.

Send a letter detailing your dispute to the credit reporting agencies that are listing this debt. By law, they must investigate this.

If the collection agent does not validate this debt, send a copy of the VOD to the credit agency, along with another demand to remove the listing.

If they still do not remove this listing, you have an excellent small claims suit against both of them for listing unvalidated debts on your credit report. You can sue them for $1000 each, and you WILL win. I've done it, it works!

File a complaint with the Federal Trade Commission. Once the bill is in the hands of a debt collector, they will not back off. These agents work on commission and all they care about is the money they get from the collection. The BBB will not be able to help you. The FTC is the organization that regulates credit matters.

where is your insurance company in all of this? they should be dealing with it and getting your bills paid by that other insurance company.

i don't understand if you have proof why are they still going after you, go figure- if it shows up on your credit report send the credit bureau proof of payment and they will take care of it on there end then you should not receive bills. If not send the new collection bureau a copy of the paid bill. then I suggest that you report everyone to the better business bureau, and anyone else who listens =be persistant

do you have one of those news programs at your local tv station that reports on ppl being taken for their money find out and try to go to them as well-public embarrasment always helps

A good way to get resolution is to get your senator or representative involved. Gather all proof and call their office and ask them to help you. They can put the fear of God into these people. I had to have them help me when I was getting hassled about my student loan. Good Luck.

YES! Gather up ALL your paper work in a nice neat folder. Go down there and be very gracious...you'll get the BEST service this way. If you don't feel satisfied, ask to see the supervisor. Don't leave until you have a written statement that you are paid in full. Good luck.

Fair Debt Collection Practices Act

The Fair Debt Collection Practices Act (FDCPA) was passed to protect customers from being shaken down by collection companies. This act restricts the tactics they may use. Please note: The FDCPA applies to outside collection agencies, the ones that most credit card companies hire after their own attempts have failed, and not to the collection department within the card company or other lender.

Studly is 100% right. I would add that if it gets onto pure harassment (more than once CONTACT a day) then you should file a cease and desist letter. These letters prohibit telephone collections to continue, and the company can only contact you in writing. The downside is that they may demand the debt in full...but if you dont really owe it, what does it matter right? FTC, Senator, Reps, Changing your number...ill bet my left nut that none of that works...FTC doesnt care as they are limited by statute (FDCPA)...Senator/Reps are politicians that have more to protect than just one person's debt...and changing your number will not work. Skip tracers will call your neighbors, pull credit files on you, call you at the local supermarket, find you at work...believe me...I know...I used to be one! I would follow studly's advice...and maybe also put a dispute on your credit bureau for this amount. If you have documentation, the dispute will notify future creditors that the chargeoff may be bogus...and if you have documentation you can prove it to them.
