I had a similar problem with a Visa debit card from Lloyds TSB. As soon as I saw the statement (they had taken 350 euros cash from a bank in Milan) I called the fraud department and they sorted it out very efficiently and immediately with just two phone calls (they called me back to verify my identity).

They needed to know, of course, that I hadn't been in Italy and that I still had the card (it had been cloned) but they were quite happy to verify this verbally on the phone (which surprised me).

Identity theft and card cloning is, unfortunately, very common and the safest thing is to make sure that the card never leaves your sight. This is one reason why chip and pin is safer than swipe-and-sign.

I also had a problem with a credit card transaction online where I never received the goods. Again, this was dealt with swiftly and efficiently by a call to the card company.

The first call should be to the card company and you should find a number for their fraud department either on the card, on the agreement or online. Hopefully the fraudulent transactions should show some anomaly .... not goods you normally purchase, not purchased from a place where you were or something like that. Nevertheless, card fraud is something that they deal with regularly and they should be able to freeze the card and cancel and refund the amounts (and the charges) quickly and routinely. Both companies are reputable ones, I believe, and I am surprised that you have had problems. I suggest that you call them again with all the facts that you can lay your hands on, especially any circumstances that you can remember where the cards might have been cloned or left your person without your knowledge.

As funny as it sounds, if you hold a balance on those cards, I would not cancel them, just make them inactive. If you cancel, the credit card co. with jack up your interest rate and you can't do anything about it. Take my word for it. Good luck.

I've never heard of a credit card company refusing to handle theft - unless you told them you still had the cards. If you still have them they would wonder how the thief got them.

Second, if you don't have them, like your wallet was stolen, you would have filed a police report immediately so that any future charges from that date would be investigated and not charged to you.

At this point, without any proof and it sounds like you still have the cards, I would call an attorney. That's your only hope. And yes, the police are right. It's not considered fraud on your account while you still have the cards unless the credit card company says so.

Call both credit card companies, report the fraud, and close the accounts. Insist on speaking to a supervisor and stating your case that you not be liable for the fradulent charges.

Then call the three major credit reporting agencies (Experian, Transunion, and Equifax) and report the fraud.

If nothing else works and you are still stuck paying off the debt, call the American Consumer Counseling Center - unlike a lot of those "debt solution" places, this is a non-profit and won't take your money. They can give you some great counseling and advise you on the best options for your particular situation, and can possibly negotiate with the credit card company to cancel the fradulent debt.

Call capital one and report the fraud. You are not liable for any fraudulent transactions. They will then contact the agent requesting money from your account and request proofs of purchase and proof of the three digit security number on the reverse of the card for on line transactions.
You can freeze the card blocking any other transactions.
You cannot freeze the interest on legitimate transactions.
You cannot close the account if you still owe money on legitimate transactions.
Apply for a credit card with a good ballance transfer rate.
pay off the fraudulent cards once frozen for the value of legitimate transactions and close the account.
keep your numbers safe and your cards secure
destroy not bin credit card reciepts

Im not sure and this will be of no help but I know of two people that have gone through it and it is a nightmare. There is almost nothing you can do. It ruins your credit.(obviously)I wish you luck.

You should not be liable for more than $50, if you report the items that are fraud to the credit card company. There will be a form that they will require you to fill out.

Make sure the accounts are closed. I don't know what you mean about freezing the interest rate. The key thing is to stop activity on the cards.

You need to be talking to the credit card fraud/security group. Don't let them push you around.

themeindzeye
You need to call the credit reporting bureaus and put a fraud alert on your information. Go to equifax.com to see about taking care of that. You also need to call a lawyer and see what they can do to help you.

I've had my Morgan Stanley card used without my knowledge, it was them that actually rang me to ask about some unusual transactions on it. They immediately cancelled the card and sent me a form to list what transactions weren't mine and that was it, i was refunded the next month. I still had the card too.

They didn't freeze the interest either but they did refund the interest that had accrued on the unauthorised transactions after it had been sorted.

It seems odd that both your cards were used without your knowledge though.
